The grievor argued that he should have been permitted to compete for the Initial Baccalaureate Degree Program (IBDP) even though he required additional time to complete his degree. As redress, he requested to be accepted in the program.

The Director General Military Careers acting as the Initial Authority denied the grievor's redress indicating that his circumstances were insufficient to justify for an exception to extend the prescribed time limitations required to be accepted in the program.

Therefore, the Committee had to determine whether the grievor was treated fairly when denied the opportunity to apply for the IBDP.

The Committee found that the grievor could have elected to pursue another degree while allowing him to continue in his current occupation. The Committee concluded that the policies did not consider exceptions to the prescribed time-limit required to be eligible to complete a degree under the IBDP and as such, the grievor did not meet the prerequisites.

The Committee recommended that the Final Authority not afford the grievor redress.
