The grievor, a Captain, argued that he should be entitled to an Acting While So Employed (AWSE) promotion in his position as Mission Crew Commander (MCC). He argued that the MCC was a Major's position and he fulfilled the duties of a higher ranked position by serving as the Flight Commander for the majority of his shifts.

The Acting Commander Military Personnel Command, acting as the Initial Authority (IA), found that the grievor's circumstances did not meet the requirements for AWSE in Canadian Forces General Message 060/00, Acting Pay/Rank. The IA did not afford redress.

The Committee found that the grievor was not employed in a position established at a higher rank. The Committee also found that a Major serving in the role of MCC and Flight Commander had a more extensive spectrum of duties than those performed by a Captain MCC.

The Committee found that the grievor did not perform the full spectrum of duties of the higher-ranked position and therefore did not meet the criteria for an AWSE promotion to the rank of Major while serving in the MCC position.

The Committee recommended that the Final Authority not afford redress.
