The grievor disagreed with a decision by the Commanding Officer of the 2nd Canadian Division Training Centre (2 Cdn Div TC) to remove them from a Basic Military Officer Qualification – Land (BMOQL) course. They alleged that their failure was due to the actions of the Section Commander (Comd), who was an instructor. Moreover, their chain of command used the evaluations signed by the Section Comd to make the decision to remove them from the course.

The Initial Authority (IA) denied the grievance, concluding that the decision to remove the grievor from the course was appropriate. The IA specified that an in-depth verification of the grievor's student file confirmed that 2 Cdn Div TC personnel followed the requirements of the course and the training plan.

The Committee reviewed all of the grievor's arguments and evaluations. It concluded that the grievor showed several deficiencies during the BMOQL course. The Committee concluded that the grievor failed to demonstrate that they met the critical requirements for completing all performance objectives. The Committee also concluded that the grievor failed to demonstrate that their evaluations were not justified.

Accordingly, the Committee concluded that the decision to remove the grievor from the BMOQL course was justified and adhered to applicable policies. It recommended to the Final Authority that the grievor not be granted redress.
