After being posted to the same location for approximately five years, the grievor was posted to Canadian Forces Base (CFB) Comox. The grievor contended that the posting to CFB Comox was not procedurally fair and that he was being treated differently than other members. The Director General Military Careers, acting as the Initial Authority, found that the grievance was submitted beyond the allotted three-month time limit and did not comment on the merits of the case.
The Committee found that the grievor was subject to being posted, just like all other Canadian Armed Forces members. The Committee also found that the decision to post the grievor to CFB Comox was taken in a procedurally fair manner and for valid service reasons, in accordance with applicable law and policy.
