The grievor alleged that they should have been enrolled at the rank of Lieutenant (Lt) upon their component transfer (CT) to the Regular Force (Reg F). Specifically, the grievor considers that they should have been promoted to the rank of Warrant Officer (WO) when they were in the Reserve Force (Res F). As redress, they requested a retroactive promotion to the rank of WO, a re-evaluation of their CT file so that it reflects an offer made to a WO, not a Sergeant, and a retroactive adjustment to their pay increment to correspond to a commission to the rank of Lt.
The Director General Military Careers, acting as Initial Authority, concluded that the grievor was treated in accordance with the policies applicable to a CT to the Reg F.
The Committee concluded that the grievor did not demonstrate that they met the conditions for promotion to the substantive rank of WO when they were in the Res F.
The Committee also concluded that the rank of Officer Cadet granted to the grievor at the time of their transfer, their simultaneous promotion to the rank of Second Lieutenant, and their subsequent promotion to the rank of Lt, were appropriate. The Committee therefore concluded that the grievor was treated in accordance with the policies applicable to promotions and to a CT to the Reg F.
Finally, the Committee considered that it would have been unfair to have selected the grievor to assume the responsibilities of a higher rank, for a period of approximately two and a half years, and not issue them the pay corresponding to the duties of a WO. As it was unable to obtain the information requested from the Canadian Armed Forces, the Committee suggested that the Final Authority (FA) take steps to confirm whether the grievor had undertaken the duties and responsibilities of a WO.
The Committee recommended to the FA that the grievor not be granted redress.
