The grievor disputed the decision requiring him to pay the Crown for a share of the security deposit withheld by his landlord at the end of his posting outside Canada and requested that he be reimbursed for his assessed share.

The Director General Compensation and Benefits, as the Initial Authority, found that the grievance was submitted outside of the prescribed time limit and returned the file without further action.

The Committee found that while the original decision had been made within the parameters of the policy articulated in the Military Foreign Service Instructions, it had been made without the benefit of additional evidence that was provided to the Committee by the grievor.

The Committee found that, on a balance of probabilities, the version of events presented by the grievor in support of writing down the entire security deposit, was more likely than that of the landlord due to the abundance of details, descriptions, dates and a fulsome explanation.

The Committee recommended that the Final Authority afford the requested redress.
