The grievor grieved the decision by the Director General Military Careers (DGMC) to exclude the position of Chief Instructor/Deputy Commandant (Tactics School) from the Infantry Corps High Range (HR) merit scoring position list. The grievor contended that this resulted in him not being considered for promotion to the next rank. As redress, the grievor sought a back-dated promotion, to have his merit file adjusted to receive HR points, and a supplemental board to re-assess his file based on his requested redress.

There was no Initial Authority decision, given that the DGMC was unable to adjudicate the grievance within the allotted timeline found in Queen's Regulations and Orders for the Canadian Forces Chapter 7, article 7.15(2).

The Committee reviewed the Selection Board (SB) Guidance Manual and applicable policy. The Committee also reviewed the SB's conducted for the fiscal years in question. The Committee confirmed that, for one fiscal year (FY), the Candidates List was based solely on Personnel Evaluation Report (PER) scores, and the grievor was not selected based on his PER scores, in accordance with the SB Guidance Manual. The Committee also found that, for other FYs, the grievor was treated fairly, consistently, and in accordance with the applicable policy. The Committee further found that the grievor's lack of promotion was justified, and as such, there was no need to hold a supplemental board to re-assess the grievor.

The Committee recommended that the Final Authority not afford the grievor redress.
