In seven grievances the Committee consolidated into one, the grievor grieved the findings of several final harassment investigation reports. As redress, he requested that the respondents in his harassment complaints be "held for harassment, physical assault, and assault of [a] sexual nature." The Initial Authority accepted the independent harassment investigators' reports findings that the grievor's allegations did not constitute harassment.
The Committee conducted a situational assessment to determine if the grievor's allegations, as stated, met the definition of harassment set out in Defence Administrative Order and Directive 5012-0, Harassment Prevention and Resolution, and the Department of National Defence Harassment Prevention and Resolution Instructions. It then examined the evidence the grievor, the respondents and witnesses provided to the harassment investigators to determine if those allegations that met the definition constituted harassment.
The Committee observed that workplace tension and conflict clearly existed between the grievor and his colleagues. However, after careful consideration of the evidence, the Committee determined it was insufficient to demonstrate on a balance of probabilities that the grievor's allegations constituted harassment.
The Committee recommended that the Final Authority not afford the grievor redress.
