Recorded Warning (RW)

The grievor, a Bombardier, received a Recorded Warning (RW) for conduct for encouraging two other members, a Bombardier and a Gunner, to participate in a performance while in uniform. The grievor argued that the members in question were not his subordinates and therefore he did not violate Queen's Regulations & Orders article 5.01(c). 

The Initial Authority (IA) determined that, on a balance of probabilities, the RW was valid. The IA found that the RW was based on information obtained from a Military Police report, and directed the grievor to address his concerns with the Military Police Complaints Commission. 

The Committee found that the RW for conduct was not justified as the grievor did not have any subordinates in the group and therefore could not have violated the specified policy. The Committee also found that the wording of the RW was inaccurate and not reflective of the facts. 

The Committee recommended that the RW be removed from the grievor's personnel files.

FA decision summary

The Commander Canadian Army, acting as Final Authority, agreed with the Committee's findings and recommendation that the RW be removed from the grievor's personnel files.
