The grievor contested the recommendations of the Progress Review Board (PRB) and the decision of the Commandant Canadian Forces Fire and Chemical, Biological, Radiological and Nuclear Academy to cease his training as a firefighter, which lead to his referral to a Base Personnel Selection Officer.

The Initial Authority rejected the grievance due to its submission outside of the prescribed time limits and determined that the grievor had not established that it was in the interests of justice to have the grievance considered notwithstanding.

The Committee found that because the grievor's student record could not be located, it was not possible to determine whether the grievor met the course failure criteria for specific performance objectives, if convening a PRB or the decision to cease his training were justified in accordance with the applicable provisions.

As such, the Committee recommended that the decision to cease the grievor's training be set aside.

FA decision summary

The Chief of Staff Chief Professional Conduct and Culture, acting as Final Authority (FA) agreed with the Committee's recommendation to uphold the grievance. The FA noted that a thorough search for the records explaining the decision to cease the grievor's training was conducted and that the grievor's file was incomplete. Therefore, the decision has to be set aside because there is insufficient evidence to justify the decision to cease the grievor's training. He noted that the grievor's allegations of harassment and abuse of authority could not be addressed unless they are brought to the attention of the correct authority in a timely and appropriate manner. He encouraged the grievor to reach out to the Conflict and Complaint Management Services office.
