The grievor argued that the move of his Household Goods and Effects (HG&E) from Toronto to St-Jean, was authorized in error by the Canadian Forces Recruitment Centre. The grievor indicated that he had been posted to Toronto for the length of the COVID-19 pandemic, and that as the move of his HG&E was a mistake, he should not have to bear the financial responsibility of moving his HG&E from the Long-Term Storage (LTS) facility in St-Jean back to his residence in the Toronto area. As redress, the grievor requested that his HG&E be moved from the LTS to his residence at public expense, or, that he be compensated should he have to pay for the move out-of-pocket.
There was no Initial Authority (IA) decision on file. After noting the four-month deadline for the IA to render a decision had passed, the grievor requested that his grievance file be submitted to the Final Authority.
The Committee noted that upon enrolment, the grievor's posting to St-Jean was prohibited. The Committee found that although it was unclear at what time the grievor had informed the Canadian Armed Forces of his common-law realtionship, the prohibited posting message the grievor received meant that he was not entitled, pursuant to Canadian Forces Administrative Order 209-28, to the move or storage of his HG&E. The Committee further noted that even though all parties acknowledged that an error had been made in shipping the grievor's HG&E to St-Jean and storing it at public expense, the grievor's HG&E were shipped back to the Toronto geographical area, again at public expense. For the period where the HG&E were inaccessible in LTS, the Committee noted that the grievor himself had wanted his HG&E in LTS, for his own convenience. As the grievor's HG&E were ultimately shipped back to the grievor at public expense, and there were no relocation costs or expenses to reimburse, the Committee found that the grievor was not aggrieved.
