The grievor contested the denial of her promotion. She argued that Special Requirements Commissioning Plan (SRCP) officers should not be required to hold a degree to be eligible for promotion, given their extensive military experience, and if such a policy did exist, it should be accessible to Canadian Armed Forces members. As redress, the grievor requested that she be promoted and it be backdated.
The Initial Authority (IA) partially granted redress. The IA acknowledged that there was some ambiguity in the interpretation of the policy governing the promotion of SRCP officers. The IA referenced Canadian Forces Administrative Orders 11-14, Canadian Forces General Messages 040/17, and the 1997 Implementation of the Degreed Officer Corps Policy (Minister of National Defence 10), noting that the degree requirement should not apply to the grievor as a member commissioned from the ranks. The IA found that since the grievor had completed her Canadian Armed Forces Junior Officer Development (CAFJOD) qualification prior to the 2021 Selection Boards, she should not have been excluded from the Selection Board Candidate List. As such, the IA directed the Director General Military Careers to review the grievor's eligibility for promotion and, if required, convene a supplementary selection board.
The Committee found that members who were commissioned from the ranks, including those in the SRCP, are exempt from the degree requirement. The Committee determined that the only requirement for promotion that applied to the grievor was the “development period 2 officer generic professional military education”, which was the CAFJOD. The Committee concluded that since the grievor held this qualification, she was erroneously bypassed for promotion when eligible and was therefore aggrieved.
The Committee recommended that the Final Authority afford the grievor redress and backdate the grievor's promotion to when she was entitled and that she receives the associated back pay.
