The grievor contested the determination of their pay rate upon component transfer (CT) from the Reserve Force as a non-commissioned member to the Regular Force as an officer. The grievor contended that they should have been paid at the rank of Second Lieutenant (2Lt) rather than Officer Cadet (OCdt).

The Initial Authority determined that the grievor had not submitted the grievance within the required time limit and that it was not in the interest of justice to consider the grievance.

The Committee noted that prior to the CT, the grievor had served three years of primarily Class “A” Reserve Force service at the rank of Private and that although the grievor had completed Basic Military Qualification, they had yet to achieve any occupational qualification. The Committee found that the grievor's CT offer correctly determined that the grievor needed to complete Basic Military Officer Qualification (BMOQ) Module (Mod) 2 before they could be promoted to 2Lt and that the offer included having the grievor attend BMOQ Mod 2 within two months of CT, providing the grievor an opportunity to swiftly achieve the rank of 2Lt. The Committee recognized that the grievor had accepted this offer but was unable to obtain the qualification.

The Committee noted that although the grievor was initially put into the OCdt Level A Pay Increment (PI) Basic pay rate, this had later been amended to the PI 3 pay rate. The Committee found that this was correctly reflective of the amount of qualifying service, academic or other special qualification of military value held by the grievor. The Committee concluded that the grievor's rank and pay had been properly determined.  

The Committee recommended that the Final Authority not afford the grievor redress.
