The grievor, a Reserve Force Cadet Organization Administration and Training Service member, disputed being prevented from working at their Cadet unit and subsequently being posted to another unit. The grievor argued that they had not been absent from their unit, that the unit Commanding Officer (CO) had no authority to ban him from working and that the posting was punitive in nature.
The Initial Authority (IA) found that the CO's decision to have the grievor removed from the unit establishment was warranted and that the CO had the authority to manage staff schedules and ensure the Cadet program was delivered effectively, efficiently and safely. The IA also found that the decision to post the grievor was done in accordance with policy and justified based on creating a conducive work environment free from workplace conflict.
The Committee noted that the circumstances stemmed from the grievor's period of absence where he was not in communication with the CO despite multiple attempts by the CO, and that this displayed a lack of accountability, responsibility and professionalism on the grievor's behalf. The Committee found that while the grievor's period of absence led to an understandable breakdown of trust, when the grievor did re-engage, they should not have been prevented from attending the unit. The Committee remarked that while the Canadian Armed Forces generally had the authority to post the grievor, an administrative review (AR) should have been conducted to first determine if a posting was a suitable administrative action. The Committee found that the grievor had been aggrieved by this lack of due process. The Committee, however, also found that there was no indication that the posting was punitive in nature and only came because of the grievor refusing to select a new unit of their own choosing.
The Committee recommended that the Final Authority direct that an AR be conducted to determine the most appropriate administrative action in the grievor's circumstances
