The grievor contested the Canadian Armed Forces' (CAF) decision to order his release under item 3(b) – On medical grounds, of the table to article 15.01 of the Queen's Regulations and Orders for the Canadian Forces following an administrative review (medical employment limitation) (AR/MEL). Specifically, the grievor believed that the assessment of his case was incorrect and that new evidence showed that his condition had improved. As redress, the grievor requested that the decision to release him be reconsidered and that his release be revoked.

The CAF's Surgeon General, acting as the Initial Authority, rejected the grievance after finding that the reviews of the grievor's file had been thorough and that the MELs assigned were reasonable, justified and in accordance with policies.

After examining the evidence, the Committee found that due consideration was given to the grievor's condition when assigning MELs which breached the universality of service principle. As result, the Committee found that the AR/MEL had correctly attributed that the reason for release was for medical reasons, such that release under item 3(b) was justified in the circumstances. The Committee recommended that the Final Authority not grant the requested redress.
