The grievor disagreed with the Responsible Officer's (RO) conclusion that his two allegations did not meet the definition of harassment under the Defence Administrative Orders and Directives 5012-0, Harassment Prevention and Resolution, and requested that his allegations be investigated.

There was no Initial Authority determination. 

The Committee found that the harassment complaint was filed within the required time frame of one year, as the second allegation occurred within that timeframe. In reviewing the first allegation, the Committee determined that the facts were not in dispute, witnesses heard the respondent make a racialized comment to the grievor, and it had a lasting impact on him. The Committee found that the first allegation met the definition of harassment. 

The Committee also found that the second allegation regarding the respondent tampering with the grievor's Personnel Evaluation Report met the definition of harassment. The Committee concluded that the RO exceeded his mandate by making a definitive finding of whether the allegations occurred without further investigation.

The Committee recommended that the Final Authority afford the grievor redress by directing a harassment investigation into both allegations.
