When the grievor was transferred from the Reserve Force (Res F) to the Regular Force as part of the Regular Officer Training Plan (ROTP), she was told that she would be appointed to the rank of officer cadet and that she would obtain the rank of Second Lieutenant (2Lt) after completing her university degree. Once she obtained her university degree, the grievor was promoted simultaneously to the ranks of 2Lt and lieutenant (Lt). However, the grievor is contesting the refusal to consider her experience as a Lt in the Res F in the calculation for her promotion to the rank of captain (Capt). As redress, the grievor requests that the period as a Lt in her previous occupation be taken into account for her promotion to the rank of Capt.
The Initial Authority (IA) concluded that the grievor had not been aggrieved and rejected the grievance, considering that Canadian Forces General Message (CANFORGEN) 071/19 specifies that, for the grievor's specialized occupational group, the officer must have acquired three years of experience as a Lt in the specialized occupation before being eligible for a promotion to the rank of Capt. As the grievor had been transferred under the ROTP without having reached the Operationally Functional Point in her military occupation group, the IA concluded that the requirement to hold the rank of Lt for three years before being eligible for a promotion to the rank of Capt is equitable and complies with the policies in effect.
The Committee established that CANFORGEN 150/15 is unequivocal regarding the obligation since 2015 to serve for three years at the rank of Lt in the new military occupational specialty before being eligible for promotion to the rank of Capt. It is a reasonable requirement and is applied more systematically in all of the specialized occupations. However, the grievor was promoted simultaneously to the ranks of 2Lt and Lt, and that decision took into account her new military occupation, her training, her experience and her previous rank achieved in the Res F. The Committee concluded that the grievor had not been aggrieved and recommended that the Final Authority not grant the redress requested by the grievor.
