The grievor contended that he was entitled to the monthly Aircrew Allowance (AIRCRA), as the positions he served in over a two-year period were retroactively deemed designated positions that were eligible to receive the allowance.
The Director General Compensation and Benefits, acting as the Initial Authority, refused to accept the grievance on the grounds that it was submitted outside the time limit prescribed in the paragraph 7.06(1) of the Queen's Regulations and Orders for the Canadian Forces.
AIRCRA (Monthly) is an allowance that compensates for the performance of duties where there is “continual and substantial exposure” to the environmental conditions associated with flying operations.
The Committee found that the grievor was a Regular Force aircrew member who was assigned to and fulfilled his duty in positions which eventually became designated positions with an effective date of 31 May 2018.
The Committee recommended that the Final Authority afford redress by directing that the grievor receive the AIRCRA for the period in question.
