The grievor contested the Director Compensation and Benefits Administration' decision to deny him reimbursement under article 8.2.13 – Home Equity Assistance (HEA) of the Canadian Armed Forces Relocation Directive (CAFRD). The grievor explained that he realized a net loss with the costs of necessary major repairs and that he was forced to sell his home quickly given the short delay in his posting change. As redress, the grievor requested a review of the policy and reconsideration of his reimbursement request.
The Director General Compensation and Benefits, acting as Initial Authority (IA), denied redress. The IA explained that the grievor was not eligible for HEA benefits as he had not suffered a loss on the sale of his home. Though the IA found that the grievor had not been aggrieved, they did note his comments for a future policy review.
The Committee found that, as the grievor had sold his home for more than he had purchased it, he was not eligible for reimbursement under article 8.2.13 of the CAFRD. The Committee noted that grievor's costs for major repairs were not admissible under article 8.2.13 or article 8.2.05 – Marketing Incentives of the CAFRD as they are considered maintenance costs. Further, the Committee explained that the grievor was not obligated to sell his principal residence so quickly and that there were other options available to him such as benefits under article 8.2.07 – Temporary Dual Residence Assistance. As such, the Committee found the grievor not aggrieved and recommended the Final Authority not grant redress.
