The grievor claimed that he should have received Specialist 2 pay, applicable to his previous trade, in accordance with Compensation and Benefits Instructions for the Canadian Forces (CBI) Chapter 204, while participating in the University Training Plan – Non-Commissioned Members (UTPNCM) program.
The Initial Authority rejected the grievance, finding that it was submitted outside of the prescribed three-month time limit set out in article 7.06 of the Queen's Regulations and Orders for the Canadian Forces.
The Committee found that upon transition into the UTPNCM as an Officer Cadet, the grievor's pay was protected at his previous level in his Non-Commissioned Member occupation, in accordance with CBI 204.30. The grievor also continued to receive the applicable pay increments and economic increases throughout his participation in the UTPNCM.
However, the Committee determined that, upon commissioning through the UTPNCM program, the grievor had transferred from his previous trade to his new military occupation and was not entitled to the Specialist pay rates for his previous trade, found under the pay tables to CBI 204.31.
The Committee recommended that the Final Authority not afford the grievor redress.
