The grievor challenged her posting to the Transition Center (TC) and her subsequent release, including her ineligibility for temporary continued employment under the Interim Reconstitution Employment Measure (IREM). As redress, the grievor requested reinstatement, or at a minimum, approval to complete the IREM, removal of statements made by supervisors in a specific form, and that personnel at Training Centers receive further education in trauma-based injuries to facilitate proper Return to Duty processes.

The Initial Authority, Commander of the Canadian Armed Forces Transition Group, could not provide a response within the timeframe established in policy and the grievor requested her grievance be referred to the Final Authority (FA) in accordance with paragraph 7.15(4) of the Queen's Regulations and Orders for the Canadian Forces.

The Committee concluded that the handling of the posting to the TC was correct, and that there is no evidence of any improper conduct by the Chain of Command. The Committee also found that the grievor did not meet the Universality of Service and that her medical release was justified. In addition, the grievor was afforded procedural fairness in that she was provided an opportunity to submit representations with respect to the Administrative Review / Medical Employment Limitations, the item and the date of release. Finally, the Committee found that the grievor's IREM request was administered in accordance with policy. The Committee recommended that the FA not afford the grievor redress.
