CRA revokes registered charity status of the Collège Rabbinique de Montréal Oir Hachaim D'Tash

OTTAWA, October 15, 2004... The Canada Revenue Agency (CRA) is revoking the registered charitable status of the Collège Rabbinique de Montréal Oir Hachaim D'Tash. The revocation is effective October 16, 2004 by way of a notice in the Canada Gazette. The CRA determined that the Collège Rabbinique was not complying with the rules as set out in the Income Tax Act. The Federal Court of Appeal agreed, finding that the Collège provided donation receipts for amounts that were not gifts, did not devote all its resources to charitable purposes and activities, failed to maintain proper books and records, and made improper loans. The Collège sought leave to appeal that court ruling to the Supreme Court of Canada which dismissed the application on September 30, 2004. As a consequence, the CRA is revoking the Collège Rabbinique's charitable status. The vast majority of the more than 80,000 Canadian registered charities operate within rules set out in the Income Tax Act. However, when an organization is not complying with these rules and so harming public trust in charities, the CRA takes an active role to ensure compliance by all registered charities.
