Canada Border Services Agency starts a dumping investigation into cross-linked polyethylene (PEX) tubing

Ottawa, March 3, 2006 - The Canada Border Services Agency (CBSA) announced today the initiation of an investigation into the alleged injurious dumping of cross-linked polyethylene tubing (PEX tubing) originating in or exported from the United States of America. The products to be investigated include nominal tubing sizes up to and including one-inch or the metric equivalent, excluding PEX tubing with an oxygen barrier layer.
The investigation follows a complaint filed by Vanguard Piping Systems (Canada) Inc. of Mississauga, Ontario. The company alleges that the dumping of the goods in question is harming Canadian production by causing price erosion, price suppression, lost sales, lost market share, capacity underutilization, and reduced profitability. Dumping occurs when goods are sold to importers in Canada at prices that are less than their selling prices in the exporter's domestic market or at unprofitable prices. The Special Import Measures Act protects Canadian producers from the damaging effects of such unfair trade.
The Canadian International Trade Tribunal (Tribunal) will now begin a preliminary inquiry to determine whether the imports are harming the Canadian producers. The Tribunal will issue a decision by May 2, 2006. While the Tribunal is examining the question of injury, the CBSA will investigate whether the imports are being dumped and will make a decision by June 1, 2006.
If there is a large increase in harmful imports and the Tribunal decides that retroactive application of anti-dumping duty is justified, duty could be levied on the goods brought into Canada as of today.
