OTTAWA, ONTARIO, December 31, 2008 – The Honourable Rona Ambrose, Minister of Labour, today advised that after careful consideration of the submissions made by the City of Ottawa and the Amalgamated Transit Union, she has directed that a vote be held on the last offer tabled by the City on December 23, pursuant to section 108.1 of the Canada Labour Code.
"I am concerned about the impacts that this work stoppage is having on the travelling public who have no other readily available mode of transport, particularly the elderly and people who are dependent on this service," said Minister Ambrose. "Therefore I have decided to provide an opportunity to the employees in the bargaining unit to accept or reject the last offer received from the employer."
"I am of the view that it is in the public interest, at this time, to direct a vote," said Minister Ambrose. "However, I maintain that the fastest way to resolve this matter is for the parties to get back to the table and reach an agreement."
The Minister designated the Canada Industrial Relations Board (CIRB) to conduct the vote as soon as possible. Furthermore, the Minister referred on December 29, 2008, the issue of maintenance of activities (essential services) to the CIRB.
"After carefully taking into consideration the concerns raised about public safety, I have asked the Board to review the existing maintenance of activities agreement between the parties to ensure that public health and safety are not jeopardized," said Minister Ambrose.
The CIRB can confirm, amend or cancel the existing agreement and may make any orders that it considers appropriate in the circumstances.
The CIRB was established on January 1, 1999, as an independent, representational, quasi-judicial tribunal. Its mandate is to interpret and apply the provisions of Part I of the Canada Labour Code dealing with bargaining rights and unfair labour practices.
