OTTAWA, August 2, 2009 - The Honourable Rob Nicholson, P.C., Q.C., M.P. for Niagara Falls, Minister of Justice and Attorney General of Canada, made the following statement today following the Superior Court of Justice’s refusal to grant an injunction preventing the Minister from executing the surrender order pending against Mr. Schreiber.
“On August 2, 2009, Mr. Schreiber was surrendered to Germany in accordance with the valid surrender order issued against him on October 31, 2004 by former Minister of Justice, Irwin Cotler.
Earlier today, Mr. Schreiber applied to the Superior Court of Ontario for an injunction to prevent me from executing the surrender order. Madam Justice Conway denied the application, having concluded that it was “the latest in a series of creative instalments to frustrate a legitimate extradition process”.
Over a 10-year period, Mr. Schreiber was given every reasonable opportunity to challenge his extradition. His surrender to Germany was in full accord with the law and consistent with the spirit and purpose of extradition.”
