On February 27, 2014, Shawn Davis pleaded guilty to the charge made by the Canada Border Services Agency (CBSA) of possessing firearms without a licence or registration certificate, a violation of the Criminal Code subsection 91(1). He was sentenced in the Abbotsford Provincial Court to a $4,000 fine and a $600 victim surcharge along with a mandatory 10-year firearms prohibition that includes any firearm, crossbow, prohibited weapon, restricted weapon, prohibited device, ammunition, prohibited ammunition or explosive substance.
On April 28, 2013, Davis sought entry into Canada at the Abbotsford-Huntingdon port of entry. Davis did not declare any firearms upon entry but did declare several knives. He was referred for a secondary examination.
When officers informed Davis that they would examine his vehicle, Davis confessed to having multiple firearms within his vehicle and claimed full ownership of the firearms in his vehicle. Davis was arrested and the vehicle was seized. The examination revealed 10 firearms and 48 magazines of ammunition.
Quick Facts
- Canadian firearm laws are clear. All persons, including Canadians, must declare all firearms and weapons in their possession when they enter Canada.
- Failure to declare goods, including firearms, and other Customs Act contraventions may lead to prosecution in a court of law.
- Restricted firearms and prohibited weapons are high-risk commodities and their interdiction is a CBSA enforcement priority. When border services officers find undeclared and/or restricted/prohibited firearms or weapons they are seized under the authority of the Customs Act.
