On August 29, 2014, Kyu Min Park was convicted of one count of use of a document contrary to the Immigration and Refugee Protection Act (IRPA) and one count of forgery under the Criminal Code. Park was given credit for 75 days of pre-sentence custody and was given an additional four months to serve for each count, to be served concurrently.
Park was arrested by Canada Border Services Agency’s (CBSA) officers with the Kingston Inland Enforcement Unit on June 18, 2014, for working illegally at a sushi restaurant in Belleville, Ontario. During the investigation, CBSA officers found forged and altered documents that showed that the expiry date of his passport had been altered to gain entry to Canada in 2011.
Park also forged a work permit and unlawfully took a former co-worker’s social insurance number (SIN) to forge a SIN card of his own, and then used the forged documents to get hired.

- The IRPA requires all foreign workers to have authorization to engage in employment in Canada.
- Foreign nationals found to be working in Canada without proper authorization are in violation of the IRPA and may be issued a removal order and could be prosecuted.
- The CBSA lays charges when there is sufficient evidence to support convictions for deliberate or willful violations of the IRPA.
