The Federal Court of Appeal has upheld a Federal Court ruling on the validity of pre-placement and random alcohol and drug testing requirements imposed by Volume II, for workers holding safety-critical positions at high-security nuclear facilities.
The decision of the Federal Court of Appeal confirms that the Commission’s decision to adopt and implement these requirements was reasonable and within its authority, and that the requirements do not breach Charter rights.
