[1] This case concerns an appeal made by the Canadian Council of Railway Operating Unions and Grant Edwards, conductor for Canadian National Railway in Prince George, British Columbia, on November 5, 2001, under subsection 129(7) of the Canada Labour Code, Part II.
[2] The appeal was made following a decision of no-danger issued by health and safety officer Brent R. Harradine on October 22, 2001, after the employee, Grant Edwards, refused to perform switching operations relative to train and yard movements.
[3] On November 8, 2001, the union advised the Canada Appeals office on Occupational Health and Safety that it was withdrawing its appeal.
[4] As the appeals officer responsible for the case, I confirm that the Canadian Council of Railway Operating Unions and Grant Edwards withdrew their appeal of the decision of no-danger rendered by health and safety officer Brent R. Harradine.
[5] After reviewing the file, the appeals officer confirms that the case is closed.
