Regulatory Initiatives - Forward Regulatory Plan: 2016-2018
This plan provides information on regulatory proposals that the Public Service Commission of Canada expects to bring forward over the next two years. It also identifies public consultation opportunities and a departmental contact point for each regulatory initiative.
There are several provisions in the Public Service Employment Act (PSEA) that provide the Public Service Commission (PSC) with the authority to make or recommend regulations. More specifically:
- Section 22 provides the Commission with the direct authority to make regulations to give effect to the provisions of the PSEA relating to matters under its jurisdiction;
- Section 21 provides that, on the recommendation of the Commission, the Governor in Council may make regulations related to how excluded positions, persons or classes thereof are to be dealt with;
- Subsection 35(4) provides that the Governor in Council may, on the recommendation of the Commission, designate any portion of the federal public administration so that persons so employed may participate in internal advertised appointment processes open to “persons employed in the public service”; and
- Subsection 113(2) provides that, on the recommendation of the Commission, the Governor in Council may make regulations specifying political activities that are deemed to impair the abilities of employees to perform their duties in a politically impartial manner.
