Transport Canada finds safety rules not followed

March 24, 2016 – Winnipeg, Manitoba – Transport Canada

Transport Canada issued today two administrative monetary penalties (fines) totalling $109,000 to Cando Contracting Ltd. for violating the Railway Safety Act and the Canadian Rail Operating Rules.

In March 2016, Cando Contracting Ltd. left a railcar loaded with asphalt unattended at an industrial plant in Regina, Saskatchewan. Transport Canada determined that the railcar’s handbrakes had not been applied and that emergency communication procedures were not followed once the railcar started to roll away from its stopped position.

Transport Canada takes its rail safety oversight role very seriously and does not hesitate to take appropriate enforcement action when the rules are not followed.

  • Since April 2015, Transport Canada can issue an administrative monetary penalty to railway companies that fail to respect the Railway Safety Act, regulations, or rules. This is the second time Transport Canada has issued an administrative monetary penalty to a railway company.
  • The Transportation Safety Board of Canada continues to investigate this incident to determine the causes and contributing factors.
