Description

Amendments to the Federal Real Property Regulations are necessary as the translated versions of the regulations do not adequately describe and harmonize the different concepts and nomenclature for real property in Common Law versus Quebec’s Civil Code. The Federal Real Property Regulations set requirements related to administering and transacting federal real property. The government’s Policy on Legislative Bijuralism (1995) and Cabinet Directive on Law-Making (2001) require, in this case, amendments to the regulations to describe and harmonize French and English, as well as Common Law and Civil Code. The parent legislation of the regulations, the Federal Real Property and Federal Immovables Act, was revised for this reason in 2001.

To meet the requirements related to bijuralism and ensure alignment of the Federal Real Property Regulations with the Federal Real Property and Federal Immovables Act.

This regulatory initiative is associated with the department’s Stock Review Plan: 2020 to 2030.

Public consultations are not applicable with regard to this regulatory initiative as there is no change to the requirements of the regulation; the amendment deals solely with technical references to the Civil Code.

Internal consultations with federal real property custodians would be undertaken.
