Section 1 - Cadet Organizations - General

2.01 CONSTITUTION OF THE ROYAL CANADIAN SEA CADETS, THE ROYAL CANADIAN ARMY CADETS, THE ROYAL CANADIAN AIR CADETS AND THE JUNIOR CANADIAN RANGERS

(1) Section 46 of the National Defence Act provides:

"46.  (1) The Minister may authorize the formation of cadet organizations under the control and supervision of the Canadian Forces to consist of persons not less than twelve years of age who have not attained the age of nineteen years.

(2) The cadet organizations referred to in subsection (1) shall be trained for such periods, administered in such manner and provided with materiel and accommodation under such conditions, and shall be subject to the authority and command of such officers, as the Minister may direct.

(3) The cadet organizations referred to in subsection (1) are not comprised in the Canadian Forces".

(2) There shall be four cadet organizations, under the control and supervision of the Canadian Forces, known as:

(a) the Royal Canadian Sea Cadets;
(b) the Royal Canadian Army Cadets;
(c) the Royal Canadian Air Cadets; and
(d) the Junior Canadian Rangers.

(3) Cadet corps authorized under QR(Cadets) shall be included in the appropriate cadet organization and shall be subject to the authority and command of cadet instructors and other officers from time to time who carry out duties and responsibilities in respect of cadet organizations (see article 2.04).

2.02 ORGANIZATION OF THE CADET INSTRUCTORS CADRE

(1) QR&O article 2.034 provides in part that:

"The sub-components of the Reserve Force are:

(a) ........;

(b) ........;

(c) the Cadet Instructors Cadre, consisting of officers who have undertaken, by the terms of their enrolment, to perform such military duty and training as may be required of them, but whose primary duty is the supervision, administration and training of cadets mentioned in section 46 of the National Defence Act; and  

(d) ........"

(2) Cadet instructors are members of the Canadian Forces, but civilian instructors and cadets are not members of the Canadian Forces.

2.03 AIMS OF THE CADET ORGANIZATIONS

The aims of the cadet organizations are to:

(a) develop in youth the attributes of good citizenship and leadership;

(b) promote physical fitness; and

(c) stimulate the interest of youth in the sea, land and air activities of the Canadian Forces.

2.04 GENERAL DUTIES AND RESPONSIBILITIES OF OFFICERS IN THE CANADIAN FORCES

An officer in the Canadian Forces shall, in addition to the general responsibilities placed on him or her by QR&O Chapter 4, carry out such duties and responsibilities in respect of cadet organizations, as may be prescribed in orders and instructions issued by the Chief of the Defence Staff.

Section 2 - Cadet Corps - Formation - General

2.10 AUTHORITY FOR FORMATION OF CADET CORPS

The Chief of the Defence Staff may authorize the formation of cadet corps within the maximum number of cadets authorized in accordance with article 2.11.

2.11 MAXIMUM NUMBERS - CADET INSTRUCTORS AND CADETS

(1) The maximum numbers of cadet instructors shall be as authorized from time to time by the Governor in Council.

(2) The maximum numbers of cadets shall be as authorized from time to time by the Minister.

(3) The Chief of the Defence Staff shall from time to time promulgate in orders the maximum numbers of cadet instructors and cadets authorized.

Section 3 - Cadet Corps - Formation - Procedures

2.20 CONDITIONS AND PROCEDURES FOR FORMING A CADET CORPS

(1) Cadet Corps may be formed in accordance with orders and instructions issued by the Chief of the Defence Staff and implemented through the appropriate chain of command.

(2) A cadet corps shall not normally be formed unless it appears that 30 or more persons will be cadets in that cadet corps.

2.21 SPONSORSHIP OF CADET CORPS

(1) A cadet corps shall have a local sponsor acceptable to the appropriate League and the Chief of the Defence Staff.

(2) Cadets who belong to a school cadet corps must be students at the school where the cadet corps was formed, but membership in an open cadet corps shall not be restricted to any particular group of persons.

2.22 CHANGE OF SPONSOR

(1) he local sponsor of a cadet corps for which The Navy League, the Army Cadet League or the Air Cadet League has accepted responsibility may be changed, on the recommendation of the Division, Provincial Branch or Provincial Committee, if the region commander and the national headquarters of the appropriate league concur in that recommendation.

(2) Procedures regarding the change of local sponsors shall be in accordance with orders and instructions issued by the Chief of the Defence Staff.

2.23 DESIGNATION

(1) A cadet corps shall be designated by a number and a name.

(2) The number and name of a cadet corps shall, subject to paragraph (3), be designated by The Navy League, the Army Cadet League or the Air Cadet League, as appropriate.

(3) Where the proposed name of a cadet corps is similar to or the same as the name of any unit of the Regular Force or of the Reserve Force, prior concurrence of the commanding officer of that unit shall be obtained, in the case of disbanded units, concurrence shall be obtained from the appropriate Regimental Association or authority.

2.24 CHANGE OF DESIGNATION

(1) When the local sponsor wishes to change the designation of a cadet corps, or when such a change is desirable because of a proposed change in affiliated unit (see article 2.26), the local sponsor shall submit to the national headquarters of the appropriate league, an application in writing which shall include.

(a) he proposed new designation;

(b) a statement of the reasons for which the change of designation is requested; and

(c) where applicable, the concurrence in writing of the commanding officer of the present and proposed affiliated unit.

(2) If the change of designation is approved, the Chief of the Defence Staff shall be informed and shall promulgate the change in accordance with established policies and procedures.

2.25 AFFILIATIONS

(1) Where practical, the region commander shall request the Chief of the Defence Staff to affiliate a cadet corps with a unit of the Regular Force or of the Reserve Force.

(2) The unit with which a cadet corps is affiliated shall:

(a) appoint a liaison officer to serve the cadet corps; and

(b) provide such assistance as may be practical to enable the cadet corps to achieve its aim.

(3) The affiliation of a cadet corps with a unit shall not place upon that unit, nor upon any of its members, any financial responsibility for the activities of the cadet corps.

2.26 CHANGE OF AFFILIATION

(1) The local sponsor of a cadet corps may make application to the Chief of the Defence Staff, through the region commander, to change the affiliated unit of that cadet corps.

(2) The application shall be submitted in writing, accompanied by:

(a) the concurrence in writing of the commanding officer of the proposed new affiliated unit;
(b) the concurrence in writing of the commanding officer of the former affiliated unit; and
(c) a statement of the reasons for requesting the change in affiliated unit.

(3) Procedures for changing the affiliation of a cadet corps shall be as prescribed by the Chief of
the Defence Staff.

2.27 CHANGE OF COMMANDING OFFICER OF A CADET CORPS

(1) The commanding officer of a cadet corps may be changed by the region commander after consultation with the local sponsor and, where appropriate, with the Division, Provincial Branch or Provincial Committee.

(2) Where a change of commanding officer of a cadet corps is approved under paragraph (1), the region commander shall direct the support unit to convene a board of inquiry which shall:

(a) examine and audit the materiel and financial records, and conduct a physical stocktaking of materiel issued to the cadet corps;

(b) list all materiel deficiencies, showing the value of those deficiencies at full catalogue value;

(c) report any damage to materiel issued to the cadet corps or for which the cadet corps is accountable; and

(d) include in the minutes

(i) a certificate, signed by the outgoing commanding officer of the cadet corps, acknowledging any deficiencies and damage, and

(ii) a certificate, signed by the new commanding officer of the cadet corps, accepting responsibility for the care and custody of the materiel shown in the equipment account of the cadet corps, less any recorded deficiencies and subject to any recorded damage.

(3) On receipt of the minutes of the board of inquiry, the region commander shall:

(a) inform the local sponsor of the results of the board of inquiry; and

(b) direct the support unit to take appropriate action to adjust the materiel and financial records of the cadet corps.

Section 4 - Cadet Corps - Canadian Forces, Cadet Leagues And Local Sponsors - Responsibilities

2.30 RESPONSIBILITIES OF THE CANADIAN FORCES

The Canadian Forces are responsible for the provision of:

(a) control, supervision and administration of cadet corps;

(b) materiel to cadet organizations, in accordance with the scales of issue approved by the Minister;

(c) training, pay and allowances for cadet instructors;

(d) funds for payment of annual grants, band grants and training bonuses, authorized by QR (Cadets) and QR&O;

(e) transportation, as authorized by the Minister;

(f) facilities and staff for cadet training centres, establishments and courses approved by the Minister;

(g) syllabi and training aids, in accordance with scales of issue approved by the Minister;

(h) medical care as authorized by QR (Cadets) and QR&O;

(i) liaison with cadet corps;

(j) officers or appropriate civilians to carry out annual inspections;

(k) policy on the enrolment, appointment, promotion, transfer and release of cadet instructors;

(l) policy respecting agreements for the employment of civilian instructors and the terms of their employment; and

(m) policy on membership requirements for cadets, promotion to cadet ranks and transfers of cadets between cadet corps.

2.31 RESPONSIBILITIES OF CADET LEAGUES

Subject to article 2.20, The Navy League, the Army Cadet League or the Air Cadet League, as appropriate, is responsible for:

(a) making recommendations to the Chief of the Defence Staff for the formation, organization, probation or disbandment of a cadet corps;

(b) recommending suitable persons for enrolment in the Canadian Forces and employment as cadet instructors;

(c) recruiting suitable persons to be cadets;

(d) making recommendations to the region commander regarding the appointment, promotion, transfer or release of cadet instructors;

(e) making recommendations for selection of civilian instructors for employment in cadet corps;

(f) providing appropriate training and stores accomodation not provided by the Canadian Forces;

(g) arranging cadet recreational programs other than environmental training programs;

(h) providing training aids and equipment, including band instruments, not supplied by the Canadian Forces;

(i) providing financial support as required;

(j) supervision of and accounting for allowances and grants made from public funds;

(k) approving and supervising local sponsors;

(l) providing transportation, when not available from the Canadian Forces, for local training exercises;

(m) providing advice and assistance to local sponsors and cadet corps; and

(n) providing such other facilities or assistance as may be mutually agreed between the appropriate league and the Canadian Forces.

2.32 RESPONSIBILITIES OF LOCAL SPONSORS

The local sponsor of a cadet corps shall be responsible for these functions as may be arranged with the appropriate league:

(a) mking recommendations to the Chief of the Defence Staff through the region commander regarding the formation, organization, probation or disbandment of the cadet corps;

(b) recommending suitable persons for enrolment in the Canadian Forces and employment in the cadets corps as cadet instructors;

(c) recruiting suitable persons to be cadets in the cadets corps;

(d) making recommendations to the region commander regarding the appointment, promotion, transfer or release of cadet instructors for the cadet corps;

(e) making recommendations for selection of civilian instructors for employment in cadet corps;

(f) providing appropriate training and stores accommodation, not provided by the Canadian Forces;

(g) providing such other facilities or assistance as may be mutually agreed between the local sponsor and the Canadian Forces;

(h) control of and accounting for allowances and grants made to the sponsor from public funds; and

(i) providing financial support as required.

2.33 RELATIONSHIPS BETWEEN THE CANADIAN FORCES, THE CADET LEAGUES AND LOCAL SPONSORS

(1) In accordance with section 46 of the National Defence Act, the Canadian Forces are responsible to the Minister of National Defence for the control and supervision of cadet organizations. In carrying out this responsibility the Canadian Forces shall take into account the known policies and objectives of the Cadet Leagues and local sponsors, and shall cooperate with them to the fullest extent possible.

(2) The Canadian Forces, The Navy League, the Army Cadet League, the Air Cadet League and the local sponsors shall give each other maximum support and recognition in ail speeches, publicity, events and other activities pertaining to cadet organizations.

Section 5 - Cadet Corps - Probation or Disbandment  

2.40 PROBATION OR DISBANDMENT OF A CADET CORPS

(1) A recommendation that a cadet corps be placed on probation or be disbanded may be made to the region commander by The Navy League of Canada, the Army Cadet League or the Air Cadet League, as appropriate.

(2) Procedures for the probation or disbandment of cadet corps shall be in accordance with orders and instructions issued by the Chief of the Defence Staff.
