Section 1 - General
35.01 - DEFINITIONS
In this chapter,
-
"
comprehensive dental treatment
" (soins dentaires complets) - means the treatment that is required to establish and maintain a reasonable degree of masticatory efficiency and freedom from pain and that is, in the opinion of the dental officer, necessary and available;

"
dependant
" (personne à charge) - has the meaning prescribed in article 209.80

"
isolated unit
" (unité isolée) - means a unit so designated by the Minister;
-
"
restricted dental treatment
" (soins dentaires restreints) -
means the treatment required in an emergency that is, in the opinion of the dental officer, necessary and available for
- the relief of pain and acute infection, or
- simple repair of broken dentures, but not including replacement or addition of component parts.

35.02 - RESPONSIBILITIES OF DENTAL OFFICERS
The senior dental officer at all levels of command is the responsible adviser to the senior officer exercising the function of command or executive authority on all matters pertaining to the dental health of all personnel under his jurisdiction.

Section 2 - Dental Care of Officers and Non-commissioned Members of the Canadian Forces
35.03 - DENTAL EXAMINATION
A member of the Canadian Forces is required to undergo dental examinations on the occasions prescribed in orders issued by the Chief of the Defence Staff.

35.04 - ENTITLEMENT TO DENTAL TREATMENT
(1) A member of the Regular Force or of the Special Force is entitled to comprehensive dental treatment except:
- beyond the 21st day of a period of absence without authority; or
- beyond the date of the member's release
(2) A member of the Reserve Force on active service, Class "B" Reserve Service for a period in excess of six months or Class "C" Reserve Service is eligible for comprehensive dental treatment.
(3) A member of the Reserve Force:
- is entitled to restricted dental treatment where the member is on
- Class "B" Reserve Service for a period not in excess of six months, or
- Class "A" Reserve Service performing duty or training other than at a local headquarters, local parade, local demonstration or local exercise; or
- is entitled, where the member suffers any injury to the teeth attributable to the performance of duty, to the treatment that is necessary to restore a state of dental fitness comparable to that which existed prior to the injury, if such injury is not attributable to the member's own misconduct or imprudence.
(4) A member of the Reserve Force who, in the opinion of an officer commanding a command, unreasonably refuses to accept the dental treatment prescribed for the member's injury or disease is not, from the date of refusal entitled to any further treatment for that injury or disease.
(5) A person subject to the Code of Service Discipline under paragraph 60(1)(d), (e), (f), (g), (h), (i) or (j) of the National Defence Act who is held in service custody shall be given restricted dental treatment.

35.05 - DENTAL TREATMENT WHILE ON LEAVE IN CANADA
(1) Where an officer or non-commissioned member who is entitled to dental treatment is on leave in Canada and requires dental treatment, the member shall report to the nearest Canadian Forces dental clinic.
(2) Where a Canadian Forces dental clinic is not available, the member may report to a civilian practitioner for restricted treatment.
(3) Accounts rendered by civilian practitioners for dental treatment obtained under paragraph (2) shall be forwarded in triplicate to the command dental officer for payment by the Department.

35.06 - DENTAL TREATMENT IN FOREIGN COUNTRIES
(1) An officer or non-commissioned member who is entitled to and requires dental treatment while in a foreign country other than the United States shall report to any available Canadian Forces dental clinic or, where such a clinic is not available, shall report in the order shown to:
- any available unit of another of Her Majesty's forces;
- the nearest diplomatic or consular authority representing Canada or the United Kingdom;
- the nearest unit of a foreign armed force; or
- a civilian dental practitioner.
(2) An officer or non-commissioned member who reports under subparagraph (1)(c) or (d) shall ensure that the nearest diplomatic or consular authority representing Canada or the United Kingdom is informed of the circumstances immediately.
(3) An officer or non-commissioned member who requires dental treatment while in the United States shall report to any available Canadian Forces dental clinic or, where such a clinic is not available, shall report in the order shown to:
- a dental service of any of the armed forces of the United States; or
- a civilian dental practitioner.
(4) An officer or non-commissioned member who reports under subparagraph (3)(b) shall:
- ensure that the Canadian Defence Liaison Staff, Washington, D.C., is informed immediately; and
- request the civilian dental practitioner or hospital authority to forward the accounts for treatment to the Canadian Defence Liaison Staff, Washington, D.C.
(5) An officer or non-commissioned member who reports to a civilian practitioner under paragraph (1) or (3) shall obtain prior approval from National Defence Headquarters when other than restricted dental treatment is required.

Section 3 - Dental Care of Dependants
35.10 - AVAILABILITY OF FACILITIES
Where considering the provision of dental care under this section, a dental officer shall ensure that the care will not interfere with the proper dental care of service personnel under the dental officer's charge.

35.11 - DENTAL TREATMENT OF DEPENDANTS - ISOLATED UNITS
(1) Subject to paragraph (2) and to any limitations prescribed by the Minister, a dependant who accompanies a member of the Regular Force or the Reserve Force on Class "C" Reserve Service serving at an isolated unit may be provided with comprehensive dental treatment to the extent available in the military dental facilities in the locality where the dependant is residing.
(2) Dental treatment provided to a dependant in accordance with paragraph (1) shall be charged for in accordance with the scale of fees authorized by the Governor in Council.
(3) When the required dental treatment is not reasonably available in the locality of the isolated unit where the dependant is residing, the officer commanding the command or formation concerned may authorize the benefits established in CBI 209.992 (Transportation of Dependants - Medical Care and Dental Treatment) for the journey to and from the nearest appropriate dental facility. Section 4 - Dental Care of Civilians
35.12 - PROVISION OF DENTAL SERVICES TO CIVILIANS
(1) Where considering the provision of dental care under this section, a dental officer shall ensure that the care will not interfere with the proper dental care of service personnel under the dental officer's charge.
(2) Subject to paragraph (1), dental treatment may be extended to civilians by the dental services of the Canadian Forces:
- at the discretion of the senior dental officer present, in an emergency, to alleviate pain and suffering;
- at an isolated unit, where no civilian dental facilities exist; or
- under such other circumstances as may be prescribed by the Minister.
(3) Dental treatment provided to a civilian in accordance with paragraph (2) shall be charged for in accordance with the scale of fees authorized by the Governor in Council.
