123.01 – REDUCTION IN RANK

For the purposes of paragraph 162.8(2)(a) of the National Defence Act, the rank of a person who has committed a service infraction may only be reduced by one substantive rank at the highest classification in the reduced rank.

123.02 – MINOR SANCTIONS

(1) For the purposes of paragraph 162.7(e) of the National Defence Act, the following minor sanctions are prescribed:

(a) confinement to ship or barracks for a period not exceeding 14 days;

(b) extra work and drill for a period not exceeding 14 days; and

(c) withholding annual leave, accumulated leave, special leave and short leave for a period not exceeding 30 days.

(2) A minor sanction must be completed within 30 days of the day it is imposed.

123.03 – CONFINEMENT TO SHIP OR BARRACKS

(1) A person undergoing the minor sanction of confinement to ship or barracks must not leave the geographic limits of their base or unit without the permission of their commanding officer.

(2) The officer conducting a summary hearing who imposes the minor sanction must ensure that

(a) the sanction is not completed in a service prison, detention barrack or unit detention barrack;

(b) the sanction does not interfere with the performance of the person’s normal duties;

(c) the person enjoys at least eight hours within each period of 24 hours where they are not required to perform normal duties or extra work and drill.
