CHAPTER 1 - INTRODUCTION AND DEFINITIONS

1.01 - TITLE

This publication shall be called the Queen's Regulations and Orders for the Canadian Military Colleges and may be cited as QR (Canmilcols).

1.02 - DEFINITIONS

"An Act respecting the Collège militaire royal de Saint-Jean"
means An Act respecting the Collège militaire royal de Saint-Jean, Statutes of Québec, 1985, Chapter 68; (17 Apr 86)
"cadet" (élève-officier)
means an office cadet who has been admitted to a college for a period of education and training;
"candidate" (candidat)
means an applicant for entry as a cadet;
"CBI" (DRAS)
means the Compensation and Benefits Instructions for the Canadian Forces;

"Chief Librarian" (bibliothécaire en chef)
means the person appointed by the Deputy Minister under delegated authority from the Public Service Commission to be the librarian in charge of the library of a college;
"college" (collège)
means one of the Canadian Military Colleges;
"Commandant" (commandant)
means the officer appointed by the Minister, on the recommendation of the Chief of the Defence Staff, to be the Commandant of a college;
"Dean" (doyen)
means a person appointed by the Deputy Minister under delegated authority from the Public Service Commission to be the chairman of one of the academic divisions of a college, or a senior administrator of a college who has been designated a Dean by the Minister;
"department" (département)
means a part of a division at a college;
"Deputy Minister" (sous-ministre)
means the Deputy Minister of National Defence;
"Director of Administration" (directeur de l'administration)
means the officer appointed by the Chief of the Defence Staff to that office at a college;
"Director of Cadets" (directeur des élèves-officiers)
means the officer appointed by the Chief of the Defence Staff to that office at a college;
"Distinguished Professor" (professeur distingué)
means a Professor of a college, deemed to be distinguished and so designated by the Minister;
"division" (section d'études)
means a part of a wing at a college, composed of two or more departments;
"Head of Department" (chef de département)
means a person appointed by the Deputy Minister under delegated authority from the Public Service Commission to be the head of one of the academic departments of a college;
"member" (militaire)
means any person enrolled in the Canadian Forces;
"Minister" (Ministre)
means the Minister of National Defence;
"officer commanding the command" (chef de commandement)
means, with respect to the colleges, the officer holding in the Department of National Defence the appointment o f Assistant Deputy Minister (Personnel) or Associate Assistant Deputy Minister (Personnel);
"Principal" (recteur)
means the person designated by the Governor in Council under section 5 of the National Defence Act to be the Principal of the Royal Military College of Canada;

"Registrar" (secrétaire général)
means the person appointed by the Deputy Minister under delegated authority from the Public Service Commission to be the Registrar of a College;
"student" (étudiant)
means any person, including a cadet or commissioned officer, enrolled in an under-graduate or post-graduate course of study at a college;
"teaching staff" (corps enseignant)
means the professors, associate professors, assistant professors and lecturers at a college, visiting and part-time instructors deemed by the Faculty Council to have professorial status and all commissioned officers instructing in the Academic Wing of a college;
"The Royal Military College of Canada Degrees Act, 1959"
means The Royal Military College of Canada Degrees Act, 1959, Statutes of Ontario, 1959, Chapter 131;
"The Royal Roads Military College Degrees Act, 1975"
means The Royal Roads Military College Degrees Act, 1975 , Statutes of British Columbia, 1975, Chapter 82; and
"wing" (escadre)
means one or more divisions having similar academic, administrative or military functions and responsibilities at a college.

(2) Unless the context otherwise requires, the definitions and rules of construction and interpretation contained in QR&O apply to QR (Canmilcols).

1.03 - QR&O

(1) Pursuant to the definition "commanding officer" in QR&O (see QR&O 1.02 (xix)(b)), the Commandant and the Director of Cadets of each of the colleges are each hereby designated as commanding officer.

(2) Members at a college remain subject to the National Defence Act, QR&O and all other regulations, orders and instructions applicable to the Canadian Forces.

CHAPTER 2 - COLLEGE GOVERNMENT

Part 1 - Constitution and Command

2.01 - AUTHORIZATION

The Canadian Military Colleges are:

  1. the Royal Military College of Canada;
  2. the Royal Roads Military College; and
  3. the Collège militaire royal de Saint-Jean.

2.02 - ROLES AND OBJECTIVES

(1) The role of the Canadian Military Colleges is to educate and train cadets and commissioned officers for a career of effective service in the Canadian Forces.

(2) The objectives of the Canadian Military Colleges are:

  1. to prepare and motivate cadets for effective service as commissioned officers in the Canadian Forces by
    1. providing a university education in both official languages in appropriate disciplines designed on a broad base to meet the unique needs of the Canadian Forces,
    2. developing qualities of leadership,
    3. developing the ability to communicate in both official languages and to understand the principles of biculturalism,
    4. developing a high standard of personal physical fitness, and
    5. stimulating an awareness of the ethic of the military profession; and
  2. to improve in appropriate fields the educational background of students who are commissioned officers in the Canadian Forces by providing undergraduate and post-graduate courses in both official languages.

2.03 - POWERS AND DUTIES OF THE MINISTER

Subsection 44(2) of the National Defence Act provides, in part, that the colleges:

"44(2) . . . shall be governed and administered in the manner prescribed by the Minister.".

2.04 - CHANCELLOR AND PRESIDENT OF THE COLLEGES

(1) The Minister is the Chancellor of the Royal Military College of Canada, the Royal Roads Military College and the Collège militaire royal de Saint-Jean. (17 Jun 86)

(2) The Minister is the President of each of the colleges.

(C)

2.05 - COMMAND AND CONTROL

(1) The officer in the Department of National Defence holding the appointment of Assistant Deputy Minister (Personnel) or Associate Assistance Deputy Minister (Personnel) shall exercise command and control over the Canadian Military Colleges and, for this purpose is, pursuant to QR&O (see QR&O 1,13(4)(b)), designated as an officer who may exercise the powers and jurisdiction of an officer commanding a command.

(2) Command at each of the colleges shall be exercised by the Commandant.

(3) In the absence of the Commandant from a college, the powers of command shall, unless the Commandant otherwise directs, be assumed by the next senior officer on the staff of the Military Wing (see article 2.80) who is present at the college.

Part II - Advisory Board

2.10 - FUNCTION

The Minister's Canadian Military Colleges Advisory Board shall:

  1. advise and make recommendations to the Minister on all matters pertaining to the colleges; and
  2. undertake, at the request of the appropriate authorities listed in article 2.16, special duties or functions relating to the colleges.

2.11 - COMPOSITION

(1) The Advisory Board is composed of:

  1. the following persons appointed by the Minister
    1. two representatives from each of the provinces of Ontario and Quebec, one representative from each of the other provinces, one representative alternatively from the Yukon and Northwest Territories and one representative from any two of the following regions: Eastern, including the Maritimes and Newfoundland, Central, including Ontario and Quebec and, Western, including the rest of Canada,
    2. two ex-cadet representatives nominated by the Royal Military College Club of Canada,
    3. one ex-cadet representative who attended Royal Roads Military College, nominated by the Royal Military College Club of Canada in consultation with the Commandant, Royal Roads Military College, and
    4. two ex-cadet representatives nominated by the Club des anciens du Collège militaire royal de Saint-Jean; and
  2. the following ex-officio, non-voting members
    1. the Deputy Minister,
    2. the Chief of the Defence Staff,
    3. the Vice-Chief of the Defence Staff,
    4. the Assistant Deputy Minister (Personnel), and
    5. the Chief Research and Development.

(2) The Minister may invite other persons to attend and participate in the discussions of the Advisory Board.

(3) The officer commanding the command shall appoint the Secretary of the Advisory Board.

2.12 - APPOINTMENTS TO OFFICE

The Minister shall make the following appointments within the Advisory Board:

  1. the Chairman of the Advisory Board who normally will be the retiring Vice-Chairman of the Advisory Board;
  2. the Vice-Chairman of the Advisory Board who normally will be a retiring Regional Committee Director of the Advisory Board; and (25 Mar 80)
  3. on the recommendation of the Chairman of the Advisory Board, three Regional Committee Directors selected from the members of the Advisory Board. (25 Mar 80)

(M)

2.13 - LENGTH OF APPOINTMENT

A member of the Advisory Board, other than an ex-officio member, will normally serve for four years, exclusive of time served as Chairman or Vice-Chairman, and the aggregate of time served by a member on the Advisory Board, including time served as Chairman or Vice-Chairman, will not normally exceed six years.

2.14 - EXECUTIVE COMMITTEE

(1) The Executive Committee of the Advisory Board is composed of the following:

  1. the Chairman of the Advisory Board;
  2. the Vice-Chairman of the Advisory Board; and
  3. the three Regional Committee Directors. (25 Mar 80)

(2) The Secretary of the Advisory Board shall be the Secretary of the Executive Committee.

2.15 - POWERS OF EXECUTIVE COMMITTEE

The Executive Committee may act on behalf of the Advisory Board in respect of urgent matters.

2.16 - REGIONAL COMMITTEES

(1) A Regional Committee, composed of members of the Advisory Board who were appointed by the Minister, shall be formed for each college by the Chairman of the Advisory Board to undertake special duties as requested by:

  1. the Minister;
  2. the Chairman of the Advisory Board;
  3. the officer commanding the command; or
  4. the colleges, through the officer commanding the command.

(2) A request that a special study be undertaken by a Regional Committee shall be made through the Secretary and Chairman of the Advisory Board to the Regional Committee.

(3) The channels of communication for reporting the results of a study shall be from the Regional Committee through the Secretary and Chairman of the Advisory Board to the authority who requested the study.

(4) A Regional Committee may, subject to article 5.08(2), enter into a personal service contract with a local consultant.

2.17 - MEETINGS

(1) The Chairman of the Advisory Board or, the Vice-Chairman in the absence of the Chairman, shall preside at meetings of the Advisory Board.

(2) Meetings shall be held as follows:

  1. the Advisory Board - at least twice annually;
  2. the Executive Committee - at least four times annually, including one immediately prior to each Advisory Board meetings; and
  3. Regional Committees - at least once annually.

2.18 - VISITS TO COLLEGES

(1) Visits to colleges by members of the Advisory Board shall be coordinated through the Secretary of the Advisory Board.

(2) On college visits, members of the Advisory Board shall be afforded every facility for inspection and for consultation with the Commandant or a representative appointed by the Commandant, and, when necessary, with members of the Faculty, staff and student body.

Part III - General Council

2.20 - FUNCTION

The General Council of the Canadian Military Colleges is responsible to the Minister for the overall operation of the colleges.

2.21 - COMPOSITION

(1) The General Council is composed of:

  1. a Chairman, who shall be the officer commanding the command or an officer not below the rank of major-general designated by the officer commanding the command; and
  2. the Commandants.

(2) The Principal shall attend meetings of the General Council to advise on academic matters. (17 January 2007)

(3) The Secretary of the General Council shall be an officer designated by the Chairman.

(4) The Chairman may invite other persons to attend and participate in the discussions of the General Council.

Part IV - Academic Council

2.30 - FUNCTION

The Academic Council of the Canadian Military Colleges is responsible to the Minister for the courses of study to be followed at the colleges, including:

  1. the broad outline of the courses needed to meet the requirements of the Canadian Forces in regard to the educational qualifications of future officers; and
  2. the coordination of the courses at the colleges to ensure uniformity of academic standards for student transferring between colleges.

2.31 - COMPOSITION

(1) The Academic Council is composed of:

  1. a Chairman, who shall be the officer commanding the command or an officer not below the rank of major-general designated by the officer commanding the command; and

(2) The Commandants shall attend meetings of the Academic Council to advise on matters relating to the overall operation of the colleges.

(3) The Secretary of the Academic Council shall be an officer designated by the Chairman.

Part V - Faculty Review Committee

2.40 - FUNCTION

The Faculty Review Committee of the Canadian Military Colleges is responsible to the Minister for matters concerning the civilian members of the teaching staff, including:

  1. qualification standards;
  2. promotions;
  3. salary scales;
  4. individual salary rates;
  5. recruitment procedures;
  6. terms and conditions of employment;
  7. basic criteria for determining the establishment for teaching staff; and
  8. selection of Distinguished Professors.

2.41 - COMPOSITION

(1) The Faculty Review Committee is composed of:

  1. a Chairman, who shall be the officer commanding the command or an officer not below the rank of major-general designated by the officer commanding the command;
  2. a Vice-Chairman, who shall be the Director General Personnel Relations at National Defence Headquarters;
  3. the Principal; (17 January 2007)
  4. a senior official named by the Secretary, Treasury Board;
  5. a member of the Public Service Commission;
  6. two indenpendent and qualified assessors named by the Minister; and
  7. the Director General Compensation and Benefits at National Defence Headquarters.

(2) The Chairman may invite others to attend and participate in the discussions of the Faculty Review Committee.

(3) Secretarial services shall be provided from the staff of the Director General Personnel Relations at National Defence Headquarters.

Part VI - Senate - The Royal Military College of Canada

2.50 - COMPOSITION AND POWERS

(1) Pursuant to the Royal Military College of Canada Degrees Act, 1959, the Senate is composed of:

  1. the President;
  2. the Commandant;
  3. the Principal;
  4. the Deans; and
  5. the Registrar, who is the Secretary of the Senate.

(2) The Senate is empowered to grant degrees and honorary degrees in arts, sciences and engineering.

Part VII - Senate - Royal Roads Military College

2.55 - COMPOSITION AND POWERS

(1) At Royal Roads Military College, the Senate shall be composed of:

  1. the President;
  2. the Commandant;
  3. the Principal;
  4. the Deans;
  5. three members of the teaching staff of the college, each elected by the Faculty Board (see article 2.70) for a term of three years; and
  6. the Registrar, who is the Secretary of the Senate.

(2) Pursuant to Royal Roads Military College Degrees Act, 1975, the Senate is empowered to grant degrees and honorary degrees.

Part VIII - Senate - Collège militaire royal de Saint-Jean

2.56 - COMPOSITION AND POWERS

(1) At the Collège militaire royal de Saint-Jean, the Senate shall be composed of:

  1. the President;
  2. the Commandant;
  3. the Principal;
  4. the Deans;
  5. one member of each of the two academic wing divisions of the College; and
  6. the Registrar who is the Secretary of the Senate.

(2) Pursuant to an Act respecting the Collège militaire royal de Saint-Jean, the Senate is empowered to grant degrees, diplomas and university certificates to members of the Canadian Forces and honorary degrees.

Part IX - Faculty Council

2.60 - FUNCTION

The Faculty Council of each college makes recommendations to the Commandant of that College on matters of an educational nature.

  1. the Principal, or a deputy appointed by the Principal, who is the Chairman;
  2. the Deans;
  3. the Heads of Departments;
  4. the Director of Cadets;

  6. other members of the senior staff (see article 2.81(b)) designated by the Chairman, as necessary.

Part X - Faculty Board

2.70 - FUNCTION

The Faculty Board at each college makes recommendations to the Faculty Council on matters of an educational nature.

The Faculty Board is composed of:

  1. the Principal, or a deputy appointed by the Principal, who is the Chairman;
  2. the members of the faculty (see article 2.82);
  3. the Director of Cadets;
  4. the Director of Administration;
  5. the officers of the Military Wing;
  6. the Chief Librarian;
  7. the Registrar, who is the Secretary of the Faculty Board;
  8. other members of the senior staff (see article 2.81(b)) designated by the Chairman, as necessary; and
  9. students representing the student body, invited by the Chairman to attend.

Part XI - Organization and Staff

2.80 - ORGANIZATION OF THE COLLEGES

A college normally is organized as follows:

  1. the Office of the Commandant;
  2. the Academic Wing;
  3. the Military Wing, including the Cadet Wing; and
  4. the Administrative Wing.

2.81 - STAFF OF THE COLLEGES

The staff of a college is composed of:

  1. the Commandant who is also the Vice Chancellor; (25 Jun 86)
  2. the senior staff, which comprises all persons, other than the Commandant, on the staff of a college who are officers or civilians of officer status; and
  3. the subordinate staff, which comprises all persons on the staff of a college, other than the Commandant and the senior staff.

2.82 - FACULTY OF THE COLLEGES

A faculty of a college is composed of:

  1. the Principal;
  2. the teaching staff;
  3. the Registrar; and
  4. the Chief Librarian.

2.83 - COMMANDANT

The duties of the Commandant include:

  1. as executive head of a college, being responsible to the Minister, through the officer commanding the command and the Chief of the Defence Staff, for the proper and efficient operation and administration of the college in accordance with QR (Canmilcols) and such other orders and instructions as may be issued from time to time;
  2. advising the Minister, through the officer commanding the command and the Chief of the Defence Staff, on such matters as seem expedient to the Commandant for promoting the interests of the college;
  3. submitting a written report each year to the Minister, through the officer commanding the command and the Chief of the Defence Staff; and
  4. as Chairman of the Senate, communicating directly with the Minister on matters within the purview of the Senate. (25 Jun 86)

2.85 - DIRECTOR OF CADETS

(1) The Director of Cadets is responsible to the Commandant for:

  1. the day-to-day exercise of command and control over the staff and students assigned to the Military Wing;
  2. the performance, supervision, discipline, assessment, evaluation, welfare and morale of the cadets;
  3. the direction of the military training and the physical education and athletic programs;
  4. the development of the military ethic in the cadets at the college;
  5. the conduct and direction of the extra-curricular recreational and social programs;
  6. the coordination of all ceremonial functions and military parades; and
  7. such other duties as the Commandant may direct.

(2) The Director of Cadets is a voting member of, and the senior military staff representative on, the Faculty Council and the Faculty Board.

2.86 - DIRECTOR OF CADETS - POWERS

Pursuant to the definition of "commanding officer" in QR&O (see QR&O 1.02(xix)(b)), the Director of Cadets is hereby designated as a commanding officer.

2.87 - DIRECTOR OF ADMINISTRATION

(1) The Director of Administration is responsible to the Commandant for:

  1. the administration of all military and civilian personnel, with the exception of the day-to-day administration of cadets;
  2. the direction of all logistic functions, including supply, finance, transportation and quartering;
  3. the coordination of medical, dental and chaplain services;
  4. the physical security of the college, including safety, fire prevention, traffic control and supervision of Commissionnaires;
  5. the central registry, the postal and telephone services; and
  6. the administration of messes and institutes.

(2) Where a Personal Assistant to the Commandant is not part of the establishment of a college, the Director of Administration is normally responsible for:

  1. public relations;
  2. visits;
  3. protocol;
  4. historical records;
  5. annual reports; and
  6. relics and trophies.

2.88 - REGISTRAR

(1) The Registrar is responsible to the Principal for:

  1. detailed day-to-day administration of the academic program;
  2. preparation of schedules, physical arrangements, printing of question papers and security of examinations;
  3. interpretation and implementation of approved academic admission standards;
  4. compilation and preservation of academic records, statistics of the college and all correspondence on these matters;
  5. liaison between the faculty of the college and civilian academic authorities at the post-secondary and pre-university levels;
  6. liaison between the faculty of the college and Canadian Forces recruiting and selection personnel; and
  7. such other duties as the Principal may assign.

(2) As Secretary of the Faculty and Faculty Board, the Registrar is responsible for:

  1. minutes and correspondence;
  2. production of the college calendar;
  3. registration of students in courses;
  4. preparation of class lists;
  5. preparation of diplomas and degrees;
  6. executive action in connection with all academic awards that are the responsibility of the Faculty Council;
  7. class schedules and classroom allocation; and
  8. counselling of students in academic matters.

2.89 - STATUS AND PRECEDENCE - FACULTY

(1) The Principal at each college takes precedence next to the Commandant in all aspects other than command.

(2) Subject to (1) of this article, the order of precedence for the faculty shall be as prescribed by the Commandant.

(3) The Commandant shall designate the civilian members of the Academic Wing who have officer status.

CHAPTER 3 - CADETS

3.01 - ADMISSION STANDARDS

Qualifications and academic standards for admission to a college as a student shall be as prescribed in orders by the Chief of the Defence Staff.

3.02 - ALLOCATION OF VACANCIES

(1) Eligible candidates shall be considered for selection in order of merit having due regard to the desirability of maintaining a representative balance between anglophone and francophone cadets, but only fifteen per cent may be cadets of the Reserve Force.

(2) Consideration shall be given to the preference of candidates for an individual college, but enrolment in any college or course of studies may be restricted by the Chief of the Defence Staff.

3.03 - SELECTION OF CANDIDATES

(1) An application for admission to a college shall be forwarded to:

  1. to the Registrar of the college;
  2. the Director of Recruiting and Selection at National Defence Headquarters;
  3. a Canadian Forces Recruiting Centre; or
  4. a Canadian Forces Recruiting Detachment.

(2) An eligible candidate shall be interviewed by a Board of Officers at a Canadian Forces Recruiting Centre or Canadian Forces Recruiting Detachment. Recommendations of the board shall be forwarded to National Defence Headquarters and, if the recommendation is that the candidate be accepted, to the appropriate College Admissions Committee for consideration.

(3) The Commandant shall appoint to the College Admissions Committee persons selected from both the Academic and Military Wings of the college.

(4) Lists of candidates considered suitable for admission to the college shall be forwarded by the Commandant to National Defence Headquarters for approval.

(5) A candidate who application for entry as a cadet has been approved shall enroll in the Canadian Forces and undertake to serve, on graduation, as an officer in the Regular Force or in the Primary Reserve, as appropriate.

3.04 - UNDERTAKING ON ADMISSION

A cadet who is not a member of the University Training Plan - Men shall undertake to remain single for the duration of training at a college, unless released from this undertaking by the Commandant.

3.05 - ORGANIZATION OF CADETS

(1) The cadets at a college shall be organized in the manner determined by the Commandant.

(2) The Director of Cadets is the commanding officer of all cadets at the college.

(A) Under article 2.86, the Director of Cadets is a commanding officer.

3.06 - SENIORITY AND APPOINTMENT OF CADETS

While attending a college, a cadet has seniority and holds such appointment within the college as may be determined by the Commandant.

3.07 - TRANSFER FROM THE RESERVE FORCE TO THE REGULAR FORCE

A cadet who is a member of the Reserve Force may, in accordance with QR&O (see QR&O 10.05), apply for transfer to the Regular Force, but must meet such conditions for transfer as are prescribed in orders issued by the Chief of the Defence Staff.

3.08 - CLASSIFICATION TRANSFER

The procedures and conditions for the transfer of a cadet from one officer classification to another for medical reasons shall be as prescribed in orders issued by the Chief of the Defence Staff.

3.09 - WITHDRAWAL OF CADETS

The Commandant may authorize the withdrawal of a cadet from a college as a result of:

  1. protracted absence;
  2. breach of discipline;
  3. failure to meet prescribed physical fitness standards;
  4. illness or disability due to physical condition not disclosed prior to admission to the college;
  5. inadequate progress;
  6. failure to pay fees as required by articles 5.01 (Annual College Fee) and 5.02 (Recreation Club Fee);
  7. unsuitability for continued training at a college; or
  8. voluntary application for withdrawal in accordance with orders issued by the Chief of the Defence Staff.

3.10 - CODE OF COLLEGE CONDUCT

(1) The Commandant shall make rules, which shall be known as the Code of College Conduct, governing the cadets at the College.

(2) The Commandant, or, subject to any limitations imposed by the Commandant, the Director of Cadets, or a military member of the senior staff or a senior cadet who has been authorized in writing by the Commandant, may impose sanctions in accordance with the table to this article against a cadet who breaches any of the rules contained in the Code of College Conduct.

(3) A record of sanctions imposed on a cadet under this article shall be maintained for the period the cadet is attending a college, but shall be destroyed when the cadet ceases to be a cadet or when the Commandant so directs, whichever first occurs. (25 Mar 80)

(4) Subject to (5) of this article, sanctions pursuant to this article shall not be imposed against a cadet more than once for the same breach of any of the rules contained in the Code of College Conduct.

(5) Action taken pursuant to this article against a cadet shall not constitute a bar to any further action under the Code of Service Discipline where the breach of any of the rules contained in the Code of College Conduct constitutes a service offence.

Normally action should not be taken against a cadet, under the Code of Service Discipline, in relation to an incident for which a sanction has been imposed under this article.

CHAPTER 4 - COLLEGE COURSE

4.01 - DURATION OF THE COLLEGE COURSE

(1) The duration of the college course leading to a degree or to a degree and a diploma on graduation is four years for a student starting in the first year at a college, and five years for a student starting in the preparatory year at the Collège militaire royal de Saint-Jean.

(2) The college years are designated as:

  1. preparatory year (only at the Collège militaire royal de Saint-Jean);
  2. first year;
  3. second year;
  4. third year; and
  5. fourth year.

(3) A college year is divided in two parts:

  1. the academic year, which is that period of time between the first day of classes and the last day of examinations; and
  2. the summer training period.

4.02 - COURSES AND STANDARDS

(1) The course of study consists of the following programs as prescribed by the Minister:

  1. academic;
  2. military;
  3. physical education and athletics; and
  4. social development.

(2) Standards for qualification and conditions for repeating a college year shall be as prescribed by or under the authority of the Minister.

4.03 - DEGREES AND DIPLOMAS ON GRADUATION

A student who successfully completed a prescribed college course shall be granted:

  1. at the Royal Military College of Canada, a degree specified in The Royal Military College of Canada Degrees Act, 1959, as determined by the Senate;
  2. at the Collège militaire royal de Saint-Jean, one of the degrees mentioned in the Act respecting the Collège militaire royal de Saint-Jean, 1985, as determined by the Senate; or (25 Jun 86)
  3. at Royal Roads Military College, a Diploma of Graduation and a degree specified in The Royal Roads Military College Degrees Act, 1975.

CHAPTER 5 - FINANCE

5.01 - ANNUAL COLLEGE FEE

(1) The annual college is $1,524 for each academic year for a cadet not entitled to the payment of the annual college fee at public expense. (2 Nov 92)

(2) A student who is a member of the Regular Force and who is not repeating an academic year shall be provided at public expense with tuition, books, instruments and other materials for that year.

(3) A student who is a member of the Regular Force and who is repeating an academic year for medical or service reasons shall be provided at public expense with tuition, books, instruments and other materials for that year.

(4) A cadet who is a member of the Regular Force shall pay:

  1. for the period during each academic year that the member resides at a college, by monthly deductions, for single quarters at the rate prescribed in QR&O (see QR&O 208.50) and for rations at the rate prescribed in QR&O (see QR&O 208.505); and
  2. if repeating an academic year at the member's expense,
    1. the annual college fee for that year at the rate specified in (1) of this article, and
    2. the amounts prescribed in QR&O (see QR&O 208.50 and 208.505) in respect of the cost of single quarters and rations at the rate prevailing on the first day of April of the then current fiscal year, for the period that the cadet resides at the college. (17 Apr 80)

(5) A cadet who is a member of the Reserve Force shall pay:

  1. the annual college fee for that year at the rate specified in (1) of this article; and
  2. the amounts prescribed in QR&O (see QR&O 208.50 and 208.505) in respect of the cost of single quarters and rations at the rate prevailing on the first day of April of the then current fiscal year, for the period that the cadet resides at the college.

(6) Not less than fifty per cent of the annual college fee and of the amounts prescribed under (4)(b)(i) and (ii), or under (5)(a) and (b) of this article, shall be paid to the Receiver General for Canada on or before the first day a cadet reports to a college, and the balance shall be paid on or before the last day of January of the same academic year.

5.02 - RECREATION CLUB FEE

(1) A Recreation Club fee of $107 for each academic year (see subparagraph 4.01(3)(a)), which shall be applied to the cost of undergraduate student activities authorized by the Commandant, shall be paid to the Commandant:

  1. by the public in respect of a student
    1. who is a member of the Regular Force and who is not repeating an academic year at the student's expense, or
    2. who is a member of the Reserve Force attending a college on a Dominion Cadetship; and (2 Nov 92)
  2. by the cadet, in any other case.

(2) The Recreation Club fee shall be paid on or before the first day a cadet, to whom article 5.01(4)(b) or 5.01(5) applies, reports to a college.

5.03 - REFUND OF FEES

(1) When a cadet withdraws during an academic year, the fees payable under articles 5.01 and 5.02, as determined for that year, shall be adjusted on the basis of the number of days attended at the college in that academic year, and the cadet shall be reimbursed for the number of days remaining in the academic year after withdrawal for which fees have been paid in advance.

(2) When a cadet transfers from the Reserve Force to the Regular Force during an academic year, the cadet shall be reimbursed the fees paid for that year under articles 5.01 and 5.02. The reimbursement of the fees paid by that cadet under article 5.01(5)(b) shall be pro-rated in respect of the number of days remaining after the transfer in the period of the academic year for which the fee was paid in advance.

5.04 - TRANSPORTATION AND TRAVELLING EXPENSES

(1) Transportation and travelling expenses for candidates, students who are members of the Regular Force on duty and students who are members of the Reserve Force on Class "B" Reserve Service shall be at the rates and subject to the conditions prescribed in Chapter 209 of the CBI.

(2) A student who is a member of the Regular Force and who is not repeating an academic year shall be paid leave transportation expenses as prescribed in CBI 209.50 (Transportation on Leave), once in each leave year.

(3) A student who is a member of the Regular Force and who is repeating an academic year for medical or service reasons shall be paid leave transportation expenses as prescribed in CBI 209.50, once in each leave year.

5.05 - PROVISION OF UNIFORMS, EQUIPMENT AND SERVICES

A cadet shall be provided, at public expense, and in accordance with the authorized scale of issue, with all uniforms, equipment and services required for attendance at a college, and subject to article 6.02, may retain the items provided at public expense.

5.06 - PRIZES AND AWARDS

(1) A Commandant may, in each college year, grant :

  1. to the graduating cadet in fourth year attaining the highest standing in military and academic proficiency, a sword with all the proper acoutrements, to be known as the "Sword of Honour";
  2. to the graduating cadet in fourth year attaining the next highest standing in military and academic proficiency, an award other than a sword, to be known as the "Award of Merit";
  3. prizes in each subject taught in an academic department in each year and, where the subject is taught in both official languages;
  4. such awards, other than swords, as may be offered to the college by service associations; and
  5. such other prizes as may be donated and accepted in recognition of specific achievements connected with the official activities of the college.

(2) To defray the cost of prizes and awards, an annual grant of $14 for each undergraduate student enrolled at a college shall be paid from public funds to the Commandant. (2 Nov 92)

5.07 - DOMINION CADETSHIPS

(1) A Dominion Cadetship may be granted by the Minister to a cadet who, being a member of the Reserve Force, enters the initial year at a college under the terms and conditions of this article. (17 Apr 80)

(2) The value of a Dominion Cadetship shall encompass:

  1. the annual college fee for the first year;
  2. the amounts prescribed in QR&O (see QR&O 208.590 and 208.505) in respect of the cost of single quarters and rations, for the first and subsequent years; and
  3. the annual Recreation Club fee for the first and subsequent years.

(3) No more than fifteen Dominion Cadetships may be granted in a college year.

(4) A candidate, to be eligible for a Dominion Cadetship, must meet the enrolment and academic standards for admission and be the child of a person who was killed, has died or is severely incapacitated as a result of service in:

  1. the Canadian Forces; and
  2. the Canadian Merchant Marine, during hostilities.

(5) Application for a Dominion Cadetship shall be made in writing, giving full particulars of the candidate's eligibility under (4) of this article, and shall normally be forwarded by the first day of March to a Canadian Forces Recruiting Centre or Canadian Forces Recruiting Detachment.

(6) The final board of selection shall submit to the Minister for approval a list of candidates recommended for Dominion Cadetships, in order of merit.

(7) A Dominion Cadetship is forfeited on failure of an academic year.

5.08 - EXPENSES INCURRED BY MEMBERS OF THE MINISTER'S ADVISORY BOARD

(1) A member of the Advisory Board attending an authorized meeting of the Advisory Board, the Executive Committee or a Regional Committee or visiting a college with a prior approval of the appropriate authority mentioned in article 2.16(1), is entitled to transportation and additional actual expenses incurred in connection with the member's duties, for each day, any part of which is spent proceeding to, attending or returning from, a meeting or a visit to a college.

(2) The Minister may authorize payment of actual and reasonable travel and incidental expenses and, with the concurrence of the Treasury Board, payment of an honorarium to a local consultant to a Regional Committee.

When a cadet dies, funeral and burial expenses as described in Chapter 210 of the CBI shall be paid by the public.

CHAPTER 6 - ADMINISTRATION

6.01 - ORDERS OF DRESS

A student shall conform to the orders of dress prescribed for the colleges.

6.02 - PERSONAL EQUIPMENT - ISSUE AND RETENTION

(1) A student shall be issued and may, subject to any conditions prescribed by the Commandant, retain personal equipment in accordance with the authorized scale of issue.

(2) A student shall not retain any of the personal equipment issued if such a student withdraws from a college, for any of the reasons stated in article 3.09, before serving 14 months.

6.03 - MEDICAL AND DENTAL CARE

(1) A student is entitled, while attending a college, to the medical and dental care authorized for a member of the Regular Force.

(2) Where a student who is a minor but not a member of the Regular Force urgently requires a surgical operation and delay in obtaining consent of the parent or guardian might be dangerous, the Commandant, on advice from the Medical Officer in consultation with another physician, may authorize the operation.

6.04 - LEAVE

(1) A student who is a member of the Regular Force shall be granted leave in accordance with QR&O.

(2) A student who is a member of the Reserve Force may be granted leave at the discretion of the Commandant.
