Description of the horizontal initiative

FCSAP provides long-term funding to address the highest priority federal contaminated sites. Although responsibility for the management and remediation of federal contaminated sites rests with responsible custodial departments, the FCSAP program is administered by ECCC with support from the TBS. Information about FCSAP can be found on the Federal Contaminated Sites Web Portal.

Shared outcome(s)

The primary objectives of FCSAP are to reduce environmental and human health risks from federal contaminated sites and to reduce the associated federal financial liabilities in the Public Accounts of Canada while giving priority to higher risk sites.

Governance structures

The Federal Contaminated Sites Assistant Deputy Ministers Steering Committee is supported by the Director Generals Committee, the Contaminated Sites Management Working Group (CSMWG) and the FCSAP Secretariat (ECCC), which provides overall program coordination.

Performance highlights

The Federal Contaminated Sites Inventory is a publicly accessible database administered by TBS. Custodians manage their federal contaminated sites according to a 10-step process, as set out in A Federal Approach to Contaminated Sites (Contaminated Sites Management Working Group, 1999). Sites suspected of contamination are identified and historical reviews of the site are conducted in steps 1 and 2; assessment and prioritization of the need for action at sites occurs through steps 3 to 6; the remediation or risk-management strategy is developed at step 7 and implemented at step 8, which is followed by confirmatory sampling at step 9 and long-term monitoring, as required, in step 10. Sites are closed once no further action is required and financial liability has been reduced to zero. Assessment funding is used to support steps 1 through 6 while remediation funding supports steps 7 through 10.

The assessment and remediation of contaminated sites often require multiple years to complete. In 2015-16, custodians undertook environmental site assessments at 200 sites. Assessment activities were completed at 126 sites. The remaining 74 sites require further assessment.

Comment on Variation

In 2015-16, FCSAP partners spent 65% of available funding; reprofiled, carried forward or cash managed 34%; and lapsed 1%. Note that the actual amount of available funding was $383.7 million, while the planned spending was $310.2 million. This difference is due to the fact that additional 2015-16 funding was made available (e.g. funding reprofiled from previous year) after the planned spending was calculated in the 2015-16 Report on Plans and Priorities.

The most common reasons why custodians did not spend all of the funds available in 2015-16 involved project delays. For example, weather conditions either prevented access to some of the sites or were inhospitable to the types of work being carried out. As well, work to implement the remediation or risk management plans for some sites has taken longer than custodians had anticipated. In addition, the refinement of project cost estimates and re-scoping of work plans resulted in lower expenditures than planned.

Provision of program oversight, administration and coordination

FCSAP Secretariat services will be provided to program partners by:

  • Developing program policies, guidance and procedures
  • Advising on allocation of program funding
  • Supporting governance committees
  • Preparing funding proposals
  • Coordinating site submissions, reporting and performance measurement

In cooperation with the TBS, the FCSAP Secretariat: supports the Director General and Assistant Deputy Minister steering committees and the Contaminated Sites Management Working Group; recommends program improvements, oversees the site approval and eligibility process; coordinates the site reporting process; manages program communications; and evaluates program performance.

In 2015-16, the FCSAP Secretariat will develop a funding proposal for renewed funding for FCSAP Phase III, review and update the program performance measurement framework, and provide guidance for custodians to improve program outcomes.

Under the Department’s role as Secretariat for the FCSAP, the following achievements are highlighted:

  • Led the development of a successful funding proposal for FCSAP Phase III (2016-17 to 2019-20) and for additional funding through Budget 2016 to accelerate assessment and remediation at federal contaminated sites;
  • Reviewed and updated the indicators and targets under the FCSAP performance measurement framework with input from federal partners;
  • Worked closely with federal custodians and TBS to ensure that information reported to the Federal Contaminated Site Inventory is accurate and complete;
  • Published the 2012-13 and 2013-14 FCSAP annual reports on the federal contaminated sites web portal and prepared a draft of the 2014-15 annual report. The FCSAP annual reports summarize activities and expenditures on FCSAP projects and provide information on the status of the inventory of federal contaminated sites;
  • Co-led the working group consisting of expert support departments and custodians such as National Defence and Transport Canada in developing guidance on perfluoroalkyl substances such as Perfluorooctane Sulfonate (PFOS) and Perfluorooctanoic Acid (PFOA);
  • Updated the Decision Making Framework to guide custodians through the federal contaminated sites management process; and
  • Assisted TBS to plan and deliver the 2016 Federal Contaminated Sites National Workshop.
Provision of expert advice, guidance, training and tools to custodians

Expert support services will be provided to custodians by:

  • Review of site classification scores and other technical documents
  • Provision of scientific and technical expert advice through the development of guidance, training and tools
  • Promotion of regulatory compliance

Through its role as an expert support department within FCSAP, ECCC will also conduct the following activities:

  • provide a central point of expert support services for custodial departments;
  • coordinate regional and headquarters activities of other expert support departments (including implementation of interdepartmental regional working groups, integrated work planning, etc.);
  • coordinate and undertake the review of site classification scores with other expert support departments;
  • lead the resolution of technical issues related to site eligibility for funding;
  • ensure that information on program tools and guidance is disseminated, that lessons learned are shared and that custodians’ needs are addressed;
  • provide technical advice and expert information on ecological risks and environmental matters [e.g. compliance promotion with federal environmental statutes, National Classification System for Contaminated Sites and Aquatic Sites Classification System scoring, Canadian Council of Ministers for the Environment (CCME) approaches, waste management, sampling design, emerging chemicals, etc.] at the site level and at the program level via the development of science-based tools, best practices, guidance documents, and environmental quality guidelines; and
  • Provided training on the assessment and management of ecological risks at FCSAP sites as well as key training on other broader program-related aspects (ex. site prioritization, site closure tool).

As an expert support department for the FCSAP program, ECCC provided technical advice to custodial departments on the management of their contaminated sites. Some specific accomplishments include:

  • Review of 30 site classification scores from federal custodians to confirm eligibility for funding and review of 227 technical documents to assist custodians during assessment and remediation projects and to promote compliance with regulations;
  • Developed draft Ecological Risk Assessments for Amphibians and finalized Monitored Natural Attenuation guidance;
  • Developed several FCSAP Advisory Bulletins to provide nationally consistent advice to custodians; and
  • Delivery of training courses including the use of real-time assessment technologies and sampling and characterization quality assurance/quality control.

Fisheries Protection Program - FCSAP Expert Support will conduct the following activities:

  • provision of scientific and technical advice to custodial departments on the management of federal contaminated sites in relation to risks/impacts to fish and fish habitat;
  • promotion of regulatory compliance with relevant federal legislation, particularly the Fisheries Protection provisions of the Fisheries Act;
  • development of guidance material and provision of training to custodial organizations on the management of FCSAP sites (e.g., Aquatic Sites Classification System and Framework for Addressing and Managing Aquatic Contaminated Sites); and
  • review of site classifications and technical documents to ensure that the potential impacts to fish and fish habitat have been appropriately considered.

During 2015-16, in its role as an Expert Support Department under the FCSAP program, Fisheries and Oceans Canada’s Fisheries Protection Program provided scientific/technical advice to 9 custodial departments on the management of their contaminated sites in relation to risks/impacts to fish and fish habitat.

This included the following in 2015-16:

  • Conducted 30 site classification reviews to confirm eligibility for FCSAP funding and 190 technical document reviews in support of site assessment and remediation/risk management to ensure that the potential impacts to fish and fish habitat were appropriately considered and to promote compliance with regulations;
  • Developed guidance material and provided training on the management of FCSAP sites to custodial organizations in the following areas: a) finalized draft of Working Harbour Guidance document; b) developed Working Harbour presentation and delivered Working Harbour Workshop; c) Developed draft updates to Framework for Addressing and Managing Aquatic Contaminated Sites; d) developed Monitored Natural Attenuation/Monitored Natural Recovery training course and delivered pilot classroom training session in Vancouver; e) developed Long-Term Monitoring II training course and delivered pilot classroom training session in Winnipeg

Provision of expert advice, guidance, training and tools to custodians

Expert support services will be provided to custodians by:

  • Review of site classification scores and other technical documents.
  • Provision of scientific and technical expert advice through the development of guidance, training and tools
  • Promotion of regulatory compliance

Health Canada (HC) will conduct the following activities:

  • provision of guidance, training and advice on human health risk assessment and risk management;
  • review of eligibility scoring documents for terrestrial and aquatic sites under the National Classification System and review human health risk assessments and remediation plans for projects;
  • participation in interdepartmental national and regional working groups;
  • development of the human health component of CCME soil quality guidelines; and
  • support custodians in communicating risk to human health

HC provided technical advice to custodial departments on the management of their contaminated sites. In particular, HC worked closely with other expert support departments and custodians (such as National Defence, Transport Canada and Natural Resources Canada) on human health related concerns from exposure to perfluoroalkyl substances (such as PFOS and PFOA) associated with federal sites impacted with these chemicals.

Other accomplishments include:

  • Review of 30 site classification scores or re-scores from federal custodians to confirm eligibility for funding and review of approximately 183 technical documents to assist custodians during assessment and remediation projects;
  • Completed final drafts of 5 technical guidance documents
  • Delivery of training (i) webinar entitled “Much to do With Arsenic” and (ii) 3 in-class courses entitled “Human Health Risk Assessment 101”

Provision of expert advice, guidance, training and tools to custodians

Expert support services will be provided to custodians by:

  • Focusing on developing solutions to procurement issues;
  • Providing training and guidance on site management tools;
  • Liaising with industry and disseminating information on innovative technologies and technologies used in individual sites; and
  • Forecasting site requirements and procurement opportunities to support linkages to other federal priorities and providing information to industry.

PSPC FCSAP Expert Support Program will conduct the following activities:

  • Developing contaminated site management tools;
  • collecting and sharing innovative and sustainable/green approaches;
  • addressing procurement issues; and
  • informing the private sector of federal demand for services.

PSPC FCSAP Expert Support:

  • developed and updated contaminated site management tools including the Guidance and Orientation for the Selection of Technologies tool, the Sustainable Development tool, and the Project Management Tools;
  • collected and shared innovative and sustainable/green approaches with custodians;
  • addressed procurement issues; and
  • informed the private sector of federal demand for services via the Demand Forecast Analysis.

Provision of program oversight, administration and coordination

Treasury Board of Canada Secretariat (TBS) will support ECCC in the management of the FCSAP Program by:

  • Ensuring that delivery of the FCSAP Program is consistent with Treasury Board policies on the management of federal real property (including federal contaminated sites); and
  • Administering and maintaining the Federal Contaminated Sites Inventory (FCSI)
TBS supports ECCC in the management of the FCSAP Program through the provision of strategic advice and policy guidance to ensure that ongoing implementation of FCSAP is undertaken in a manner that is consistent with Treasury Board policies on management of federal real property, including federal contaminated sites. In this role, TBS will advise ECCC on monitoring of government-wide progress, administer the Federal Contaminated Sites Inventory, and coordinate planning for the biennial Federal Contaminated Sites National Workshop to be held in 2016.

TBS supported ECCC in the management of the FCSAP program through the provision of strategic advice and guidance. In this role, TBS:

  • Supported ECCC in the development of a funding proposal seeking funding for FCSAP Phase III;
  • Supported ECCC in the development of a proposal for accelerating FCSAP activities as part of Budget 2016 infrastructure funding;
  • Supported ECCC in monitoring government-wide progress on federal contaminated sites by participating in key program activities such as program renewal and annual reporting;
  • Maintained and enhanced the FCSI;
  • Coordinated planning for the Federal Contaminated Sites National Workshop, delivered in April 2016.
