Annex 5: Provisions related to Methyl Bromide

The proposed changes to provisions related to physical transfers of methyl bromide are detailed below:

•  It is prohibited for anyone to use or sell methyl bromide and a product containing it, except in any of the following cases:

• it was manufactured or imported before January 1, 2005;

• it was imported for use as feedstock and it is sold for use for that same purpose;

• it was imported for use for a laboratory and analytical use and it is sold for use for that same purpose;

• it was imported for use as a quarantine application, a preshipment application, a critical use or an emergency use and it is sold for use for any of those purposes;

• it is used for a critical use or an emergency use in accordance with a permit; and

• it is sold for destruction.
