Environmental emergency regulations: filing a notice

Pick the appropriate type of notice that you wish to fill out from the selection below. To create a Notice of Implementation and Testing you will first have to have submitted a Notice of Preparation. You will be prompted to search for the appropriate Notice before filling in your Implementation information. Filling out the information required is broken up into one step for each notice. Only use the 'Finish' button when you have completed your notice and you wish to submit it.

If you need to update your contact information, make a change (e.g., add a substance) or correction to an existing notice, please contact your for assistance. Please do not create a new ID and submit a new notice.

1. Notice of identification of substance and place

This is to be submitted within 90 days of the regulations coming into force, or 90 days after a substance reaches or exceeds the prescribed quantity.

The notice shall identify:

  • the facilities to which the regulations are applicable,
  • the location of the facility,
  • the applicable substance/substances,
  • the maximum amounts used or stored at anytime during a year.

On completing an online notice of certification, a printable form will be generated. This form must be signed by the appropriate authority, and mailed to the Regional Environment and Climate Change Canada address given at the top of the form. Please keep a copy of the form for your records.

2. Notice of preparation

This notice indicates that the required E2 plan has been prepared, and is to be submitted within six months of the regulations coming into force, or six months after a substance reaches or exceeds the prescribed quantity.

On completing an online notice of preparation, a printable form will be generated. This form must be signed by the appropriate authority, and mailed to the Regional Environment and Climate Change Canada address given at the top of the form. Please keep a copy of the form for your records.

3. Notice of implementation and testing

This notice indicates that the E2 plan has been tested and implemented. It is to be submitted within a year of the regulations coming into force, or a year after a substance reaches or exceeds the prescribed quantity. An environmental emergency plan can be considered implemented when it is operational to the point where the person submitting the notice can expect to successfully deal with all aspects of an environmental emergency.

Implementation includes prevention, preparedness, response and recovery documentation, access to the identified response resources, training, and testing sufficient to validate the plan. It should include provision for annual testing and review of the E2 plan, including keeping records of the results.
