New substances: advisory note August 2014

Explanatory note to accompany The Regulations Amending the New Substances Notification Regulations (Chemicals and Polymers) and the Export of Substances on the Export Control List Regulations

This note is meant to inform you of the publication in the Canada Gazette, Part I, which proposes an amendment to the New Substances Notification Regulations (Chemicals and Polymers) (the Regulations).  A 60-day comment period is underway.  The publication can be accessed online.

The proposed amendments are administrative in nature consisting of a minor revision to the definition in subsection 1(1), changing the term “Material Safety Data Sheet (MSDS)” to the term “Safety Data Sheet (SDS)” in response to the implementation of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS).

All Schedules of the Regulations require that a Material Safety Data Sheet (MSDS) be provided if available, therefore the proposed amendment replace the terms “Material Safety Data Sheet” with “Safety Data Sheet (SDS)” in:

  • Section 7 of Schedule 1;
  • Section 12 of Schedule 3;
  • Section 6 of Schedule 4; and
  • Section 12 of Schedule 9.
