Service Standard for Claims for Exemption for Confidential Business Information

Service Description:

Health Canada posts service standards and performance information for services with over 100 regulatory authorizations, such as permits or licences, issued each year (i.e., high-volume regulatory transactions).

This service is a high-volume regulatory transaction used when an employer or supplier of a hazardous product files a claim for exemption with Health Canada under the Hazardous Materials Information Review Act (HMIRA). The exemption is from having to disclose Confidential Business Information (CBI) such as the chemical identity of one or more trade-secret hazardous ingredients. The HMIRA provides the mechanism to allow suppliers and employers to protect CBI, while requiring that all critical hazard information be disclosed on the Safety Data Sheets (SDSs) and labels.

Once a Claim for Exemption Application is submitted to Health Canada with all the required information necessary to complete an evaluation, an HMIRA Registry Number is assigned. Under the Hazardous Products Regulations, the Health Canada assigned registry number must be displayed on the SDS (or label, if applicable) of a hazardous product in order to import or sell the product in Canada without disclosing the CBI. The Hazardous Materials Information Review Regulations (HMIRR) sets out the requirements for a screening officer to assign a registry number.

Service Standard:

Health Canada’s Workplace Hazardous Materials Bureau commits to a service delivery standard of 7 calendar days from the date of the receipt of a complete application, for the issuance of a registry number on a claim for exemption for Confidential Business Information (CBI).

Performance Target:

The target for achieving this standard is set at 95%.

Performance result for fiscal year 2017 to 2018:

The Bureau processed 99% of claims for exemption applications within its service standard.
