Consultation on Regulations amending the Radiation Emitting Devices Regulations (Laser Products): Closed consultation

Health Canada published proposed amendments to the Radiation Emitting Devices Regulations pertaining to laser products in Canada Gazette Part I. We gathered input on the proposed amendments and the potential impact they may have on regulated parties and interested members of the public.
Who is the focus of this consultation
We engaged with:
- academic institutions
- test and certification labs
- all interested members of the public
- standards development organizations
- organizations, groups or individuals that use laser devices
- manufacturers, importers, and retailers of laser devices, and related trade associations
We’ll consider the input gathered through this process as we refine the proposed regulations for publication in Canada Gazette II.
What we heard:
A total of 23 submissions were received either through the Online Regulatory Consultation System or by email. Contributors included academia, businesses, associations, organizations, and individuals.
In general, most stakeholders supported the proposed approach to align laser product requirements with those of the International Electrotechnical Commission standard and agreed that the existing regulations needed to be updated. Certain stakeholders provided comments on aspects of laser safety that were outside of the scope of the proposal or outside of the federal mandate. Concerns from industry related to clarity around exemptions and specific aspects of labelling and information requirements.
Sections of the Regulatory Impact Assessment Summary (RIAS) will be refined to further clarify the scope of the regulations including exemptions and to elaborate on aspects of labelling and information (e.g., date of manufacture) requirements. Subject to comments received from one stakeholder regarding the need to consider integrators in assessing impacts, the Cost Benefit Analysis section of the RIAS was also reviewed and refined to capture this group in those calculations. The division of responsibilities between the federal and provincial and territorial authorities in the oversight of training and use of laser products will also be clarified.
