Amendment to the Memorandum of Understanding between Citizenship and Immigration Canada and Alberta Human Resources and Employment on Sponsorship

Between
The Government of Canada, Department of Citizenship and Immigration Canada as represented by the Deputy Minister of Citizenship and Immigration Canada (herein after referred to as “Canada”);
And
The Government of Alberta, as represented by the Deputy Minister of Alberta Human Resources & Employment (hereinafter referred to as “Alberta”);
Canada and Alberta have previously agreed to share information for the purpose of administrating and enforcing their respective legislation and to ensure the efficient and effective operation of their respective programs.
A Memorandum of Understanding was signed on behalf of Canada on September 8, 2003, and on behalf of Alberta on June 12, 2003. Alberta and Canada have agreed to amend this Memorandum of Understanding as a result of the coming into force of Alberta’s Income and Employment Supports Act (S.A. 2003, c. I-O.5).
These changes are agreed to take effect from the date on which it is signed by the last of the parties to do so.
The parties agree as follows:
1. Page 1, paragraph (a) will be removed and replaced with:
(a) administering and enforcing the former Social Development Act (R.S.A. 2000, c. S-12), the Income and Employment Supports Act (S.A. 2003, c. I-O.5), the Assured Income for the Severely Handicapped Act (R.S.A. 2000, c. A-45), and Schedule 3 of the Grants, Donations and Loans Regulation enacted under the Government Organization Act (R.S.A. 2000, c. G-13) or carrying out a lawful investigation thereunder; and,
2. Page 2, Clause 2.1 (a) will be removed and replaced with:
(a) the former Social Development Act (R.S.A. 2000, c. S-12), the Income and Employment Supports Act (S.A. 2003, c. I-O.5), the Assured Income for the Severely Handicapped Act (R.S.A. 2000, c. A-45), and Schedule 3 of the Grants, Donations and Loans Regulation enacted under the Government Organization Act (R.S.A. 2000, c. G-13) or carry out a lawful investigation thereunder; and,
3. Page 4, the first paragraph of Clause 3.2 will be removed and replaced with:
3.2 Upon being provided by Canada with the name, date of birth and if known, the provincial Person Identification Number of an individual, Alberta will search its records and, if the individual is currently or since 1985 has been in receipt of social assistance, as designated by Alberta in clauses 4.2 and 4.3, under the former Social Development Act (R.S.A. 2000, c. S-12), the Income and Employment Supports Act (S.A. 2003, c. I-O.5), the Assured Income for the Severely Handicapped Act (R.S.A. 2000, c.A-45), or Schedule 3 of the Grants, Donations and Loans Regulation enacted under the Government Organization Act (R.S.A. 2000, c. G-13) provide Canada, if available, the following information about the individual:
4. Page 5, Clause 4.2 (a) will be removed and replaced with:
4.2 (a) “income support and benefits” under the Income and Employment Supports Act (S.A. 2003, c. I-O.5) except where the individual is receiving benefits by reason of a provincially recognized disability, specifically:
- a benefit provided to a household described in section 6(1)(a)(ii) of the Income and Employment Supports Act (S.A. 2003 c. I-O.5) as “not expected to work”; or
- a “handicap benefit” under the Assured Income for the Severely Handicapped Act (R.S.A. 2000, c. A-45); or
5. Page 5, to Clause 4.3 add:
(d) “income support and benefits” under the Income and Employment Supports Act (S.A. 2003 c. I-O.5)
This amendment to the Memorandum of Understanding has been signed on behalf of Canada, Department of Citizenship and Immigration Canada as represented by the Deputy Minister of Citizenship and Immigration Canada, and on behalf of Alberta as represented by the Deputy Minister of Alberta Human Resources and Employment.
