Judicial Review: Federal Court decides to dismiss the application

This section contains policy, procedures and guidance used by IRCC staff. It is posted on the department’s website as a courtesy to stakeholders.

Where the Court is satisfied that the decision was arrived at in a lawful manner, the application for judicial review will be dismissed and the decision-maker's/citizenship judge's decision will be upheld. The local Citizenship and Immigration office is notified and ensures that the file is closed and forwarded to the Case Processing Centre in Sydney for file retirement. The right of citizenship fee is refunded, if applicable.
