The exclusion clauses are an integral part of the definition of a Convention refugee set out in the 1951 Convention Relating to the Status of Refugees. The Immigration and Refugee Protection Act (IRPA) also includes provisions to exclude in the context of pre-removal risk assessments (PRRAs). Instructions are published on how to assess an exclusion, including the crimes justifying an exclusion, modes of liability, complicity and defences, as well as how to process a PRRA when an exclusion is considered.
