IRCC’s response to a request for information made by the Standing Committee on Citizenship and Immigration on October 24, 2023

Question

MP Kwan: In the longer term - for those students who the Task Force found to be genuine, some are still wondering what will happen after the TRP and work permit expire. Some have PR applications in progress. They are asking, has or will this process affect or delay their applications?

Response

We recognize that many of these students came to Canada with sincere intentions to study – we are not looking to penalize them. The work of this taskforce is ongoing. We remain focused on supporting genuine students who wish to stay in Canada, while ensuring that bad actors are held to account.

For each of these students, Immigration, Refugees and Citizenship Canada (IRCC) added notes in the Global Case Management System to advise the processing officer that the processing of any open or new application for permanent residence should stop and the case should immediately be referred to the Task Force. Once referred to the Task Force, the case will be put before the Assistant Deputy Minister (ADM) for decision to apply humanitarian and compassionate grounds to overcome the misrepresentation inadmissibility. Applicants would need to meet all other eligibility and admissibility requirements under the Immigration and Refugee Protection Act and supporting Regulations.

Any foreign national can submit an application to extend their work permit/study permit/Temporary resident permit (TRP). IRCC added a note in the Global Case Management System for each of these students advising to refer cases to the IRCC Task Force for ADM decision if an extension of their work permit/study permit/TRP is received.

This process would not delay the applications.
