The grievor, a single officer without dependants, was posted from one location to another and received one-half month's pay posting allowance (PA), in accordance with the regulations. The grievor found it unfair that members with dependants received a full month's pay PA and submitted a grievance, claiming that this practice was discriminatory. He requested that the policy be changed and that he receive a full month's pay PA.
The Board noted that PA consisted of two elements: a basic allowance element (BAE) and a dependant allowance element (DAE). All members receive the BAE on posting, and only those members who relocate their dependants receive the DAE.
The Board found that, based on expected expenses and upheaval caused by moving several family members, versus moving an individual, the PA scheme with the two elements was neither unfair, nor was it unfairly applied to the grievor.
The Board noted that the DAE was not based on marital/dependant status as was claimed by the grievor but was based on the movement of dependants. The Board therefore found that the grievor had not established a prima facia case of discrimination.
The Board recommended the grievance be denied.
