The grievor sought an increase in the number of Pay Increments he had been awarded on transfer from the Primary Reserve to the Regular Force because he considered that, as a trained Primary Reserve Lieutenant, he should not be paid less than a Primary Reserve Private or Corporal with similar experience on transfer as a Direct Entry Officer (DEO).
As the Initial Authority for the rate of pay issue, the Acting Director General Compensation and Benefits (A/DGCB) acknowledged that the pay rates offered for Non-commissioned Members (NCM) under the DEO plan did result in a slightly disproportionate credit being given to a more Junior NCM. However, she denied this portion of the grievance, pointing out that the pay rates set out in Compensation and Benefits Instructions (CBI) are established by the Treasury Board (TB) and that the Canadian Forces (CF) has no means or authority to deviate from their provisions.
The Committee agreed with the A/DGCB that the CF had no latitude to deviate from the pay policy approved by the TB and that, while it was open to the CF to consider this issue in their next pay review, the grievor had been treated in accordance with the current policy.
As the Initial Authority for the Pay Increments, the Director General Military Careers (DGMC) denied this portion of the grievance, indicating that, with the correction of an error on transfer, the grievor had been properly credited for his eligible Primary Reserve service.
The Committee noted that the grievor's circumstances are addressed by the CBI 204.015 which is the TB approved method of recognizing qualifying service for pay purposes and that the CF has no means or authority to deviate from their provisions. The Committee agreed with the DGMC that the grievor's Primary Reserve Service had been correctly credited and found that he was receiving the correct Pay Increment.
The Committee recommended that the grievance be denied.
