Case Summary

The grievor filed a complaint with her Responsible Officer (RO) alleging several incidents of sexual and other types of harassment by a superior officer.

The RO's Situational Assessment (SA) found that some of the grievor's allegations were out of time and that others did not meet the established criteria for harassment. The RO subsequently issued a letter of administrative closure that confirmed the original SA finding. The Initial Authority acknowledged that the grievor should have received a detailed explanation for the initial dismissal of the complaint, but found that the subsequently issued letter of administrative closure remedied the injustice.

The Committee first addressed the timing of the allegations and found that the RO should have exercised discretion to consider the allegations that were originally dismissed as being out of time. The Committee also found that the SA was not conducted in accordance with CAF harassment policy and so it conducted its own SA. The Committee found that several of the allegations met the definition of harassment and that the RO should have directed an investigation into those allegations.

The Committee recommended that the CAF properly investigate those allegations that meet the definition of harassment under the SA test. The Committee also recommended that should any of the allegations be deemed founded, efforts should be undertaken to correct any negative consequences to the grievor's career that may have resulted from the harassment.

The CDS agreed with the Committee's findings and recommendation that the allegations of the harassment complaint which meet the definition of harassment be properly investigated in accordance with the provisions of the Harassment Prevention and Resolution Guidelines.
