The grievor, a Cadet Instructor Cadre officer, decided on his own to meet with the Chair of the External Review Committee on Sexual Misconduct and Sexual Harassment in the Canadian Armed Forces (CAF), without seeking approval of his chain of command. He then submitted a grievance requesting to be paid for 2.5 days for preparation and attendance at the meeting as well as for his travel expenses.

The Committee found that these were exceptional circumstance where the Chief of the Defence Staff had issued a CAF-wide email encouraging full co-operation with the External Review and inviting CAF members to contact the Chair of the External Review directly. Under these circumstances, the Committee found the grievor's request was reasonable and he should be paid for his time and travel expenses, even though he had not sought authorization in advance.
